If she has not complied with the divorce decree, you can file for contempt.

Q: Wife told me she is moving out on the 1st, it is the 27th. What about the household bills she is responsible for.

Is 30 days notice needed? I have not been served divorce papers but she has scripted a custody agreement I have not consented to. She plans to take the kids on the 1st

No one is automatically obligated to pay bills for a home they are leaving. If her income vastly exceeds your, it is possible that the court can order her to pay some of the expenses of the marital home. You need to look at your agreement. If the order doesn't say that she has a time limit tp send the bills, then there isn't one.

You should probably hire an attorney. But the best thing you can do now is stop using drugs and follow the case plan. They will give you a case plan to follow to help you get her back. Best of luck.

You will have to file a motion to try to change the order. It is unlikely to be successful unless you have a very good reason. "I changed my mind" is not a good reason.

Call Atlanta Legal Aid. Custody cases are difficult and time intensive, and it's hard to ask a stranger to provide a valuable service for free. Legal aid is free and the sometimes will assist victims of domestic violence.

The financial affidavit outlines your income, assets, debts and expenses. The child support worksheet is what will contain the child support amount. You will have to know what information to input and where in order for the worksheet to work the way it was intended.

The answer to this depends on if you have a parenting plan in a different case. If there is a court ordered parenting plan, the parenting time should resume. There isn't enough information to answer your question. I can't tell if the children were born during the marriage, or before. That matters in terms of whether he has rights. You should talk to an attorney about your options.

No one is automatically entitled to half. The court decides how the assets will be divided, and the legal standard is whatever is fair, which may or may not be half. The 8 month absence may or may not be a factor. Talk to an attorney about your options.

Just tell her no. If she sues you for custody, get a lawyer. You probably will need to get your own place with the children.

You need to speak to an attorney asap to have a solid plan in place. If he files and serves you, you cannot move until the court allows it. So, you need to act quickly to speak to an attorney who can advise you whether such a move is advisable.
