Q: Can I ask for a certain amount of money in a divorce after only 3 months?

He recently physically beat me and was jailed for domestic violence. I also quit my job because he wanted me to and promised to take care of me. This is my first marriage and I'm 47 years old.

You can always ask for it. Whether or not you receive it will be up to the judge who hears your case.

No. For it to be enforceable, the spouse will eventually need to be served papers.

If you are still married you can go get them and there is nothing she can do about it. You both have equal custody. You can go to legal aid to try and obtain a lawyer but it’s mostly for persons who have been abused that qualify. You need to get to an attorney immediately. Some will take payments or draw the money out of savings. But get to an attorney as quickly as possible! Good luck!

Q: At what age can the child legally decide to stop going to visitation with other parent?

We're divorced and I have full custody. My ex has supervised visitation and over time normal visits may resume my soon to be 12 year old doesn't want to have anything to do with him because of mental and emotional abuse on his behalf.

There is no age in Alabama when a child can decide they don’t want to go visit. I lot of people think there is, but there is not. Just as he is ordered to pay child support, you too, are ordered to comply with the visitation schedule. Good luck.

Q: Hello, My question is there a status of limitations on child support in the state of Alabama? my kids are adults now.

There was a court order when the divorced was final.

There is no statute of limitations on the collection of child support. Each monthly payment in automatically considered reduced to a judgment as it becomes due.

Q: Can defendant in uncontested divorce sign waiver to avoid response period or default judgement and proceed immediately?

Everything is agreed upon, he agrees to proceed without dispute. Does the waiver exempt us from needing to file an answer or wait through the response period

Q: Can I be charged for months while court was closed due to coronavirus?

Divorce lawyer said $4,000 retainer fee was more than enough. Court hearings were put on hold for months during coronavirus, yet the lawyer kept racking up the bill somehow and now says I owe $6,000 more. Is this legal? Can the charges rack up even when everything was closed?

Some lawyers do pro bono work and will do it for free, but they cannot pay the filing fee for you. Most countries is between 200- to 300 dollars. However, you can fill out an affidavit of hardship to possibly waive the filing fee. Good luck

Q: My wife is filing for divorce and we have a 5 yr old, we both have agreed on joint custody with no child support.

She asked me how much$ can I commit to giving a month for the Divorce paperwork she doing!
