Bio dad pays child support but doesn't check on child or attempt to be a decent dad. My daughter has not been legitimized by her bio father. Is name change or adoption possible?

You would have to apply for temporary guardianship, even though the mother has "given it to you." Q: My son exited custody to non biological family from when we were both put in dcs and split up I want to get him back.

You are only going to be able to have a relationship with the child to the extent the mother allows you to. There is no avenue for you to obtain legal rights to the child absent a step-parent adoption.
