Q: Young mother signed rights of child to her mother while homeless and unstable. can mother receive rights again?

young mother is now stable with a job home and car.

Either her mother adopted the child or got guardianship.

If it was guardianship, then she can petition the court to terminate the guardianship because the reasons for its creation no longer exist.

Q: Both parents agree to 50/50 custody. Neither wants child support. What's the best way to proceed to make that happen?

No order in court yet. Will be doing this soon, both have representation but interested to hear other viewpoints. One lawyer says reserve judgement but I don't believe that removes the risk, just pushes it down the line. Is this true?

One of you needs to file the case in court. That person should work with an attorney to advise you on this. You could get all the way to court for the final day and the Judge does not agree to your deal about no one paying child support.

Q: If I am proven not to be the biological father in Missouri and now she is trying to get child support on me through IL.

Should I get a copy of the court order and send it to Springfield Child support office?

You cannot be proven not to be the father. You can be excluded as the father. Send the dna results and the court order to the office that is contacting you.

Q: I had 2 hearings . Support on 13th, mediation status on 17th. I did not go on 13th signed all papers advance.

The lawyers are correct. Jurisdiction was vested in fl when the case was filed. I would suggest that you hire a lawyer here and file here. Fl should be confronted about declining jurisdiction. Until then, u cannot proceed in il. It is a procedural issue though. I can't imagine that a... View More

Q: An emergency OP was denied on 1/30 but now I see a hearing for an OP 2/15. Should I have been served?

Or notified to show up to court? I only learned about it by looking up my cases for another matter.

The emergency could have been denied and you would not have had notice of it. But a plenary hrg could still be held. Yes, you should be served.

Q: Oldest doesn't live with either parent. Has some college classes and has a job. Do I still pay child support on her?

The child should be in school full time, which is 12 hours per semester, generally, 4 classes.

Q: How can I find out how the support order is written.it just says support ends in 2019 but I already pay for arrears

In the child support order.So will I have to continue to pay the arrears and the child support ends or will I still have to pay both

It depends on exactly how the order is written. I usually write them such that when current support ends, you continue to pay the same amount each month until the arrears are paid off.

Q: What form would I use to add Child support if it was reserved on original agreement?

Wife moved to FL right after the divorce she was to have residential custody , but I now have had our daughter living with me for the last 5 years and need to have her pay child support.

Motion to modify c.s. and file it asap. The law is more favorable before it changes on july 1.

Yes, usually we average your annual net income from the previous year and child support is based on that.

in our papers it has he has to if he has a job that offers insurance. he is self employed and his business is fully insured. does he have to have insurance on our daughter?

Q: can I still received child support if I move to another state?

I plan on moving to another state with my child, which lives with me year round,I notified the father and he is fine with it. What action would I have to take to keep recieving the child support other than change of address? Me and him was never married nor lived together.

Make sure you file an agreement with the court that he signs letting you move out of state. Changing the address is the other thing you need to do.

It depends on what the court order states regarding use of the tax exemption. Even if the order gives him the exemption, you may want to go to court over it if he has not been keeping up with his child support obligations.

The court order should be followed eegarding parenting time and child support. However, given that there is a new status quo, she should speak withsancattorney prior to changing it.

You did not go back to court so you owe the money. You will have to make an agreement with the child support people re your license.
