Yes, the officer can write a citation after the fact. However, you should have been sent a notice of the violation. Consider speaking with a local criminal/traffic attorney.

If you go to court, the standard of proof is preponderance of the evidence, so if the officer says you were speeding even less than what he wrote the ticket for you will still have a judgment on your record and likely increased insurance rates. You should expect to be charged with a felony OWI since it has been less than 7 years from your last conviction.

If your license is an Indiana license, you will be suspended for failure to file proof of insurance, the suspension will be 90 days or more and will have a reinstatement fee. You may qualify for specialized driving privileges.

You should contact a local traffic attorney who can assist you with the suspensions and any pending case. If for some reason its not possible to get you valid quickly, you may qualify for a specialized driving privileges.

Q: I paid off a 9 year old ticket for disregarding a stop sign and as soon as I paid it the BMV placed a pending suspension

Possibly. If the DWS is a misdemeanor then a new criminal charge could get your bond revoked. If you have an attorney on the drug case you should consult with them about the new situation, it may be possible to get the warrant recalled.

It really depends on the conditions the Court put in the SDP order, however, its a non moving violation and should not affect the SDP.

Before paying the ticket, consider calling the prosecutors office to see if they would be willing to work with you. Additionally, most of the ticket costs is the court costs which are $135.50. The prosecutor may be willing to dismiss for compliance.

You should consider speaking with an attorney before going to court. If you go and admit the violation it will add a minimum of 4 points to your record and likely increase your insurance costs considerably for the next three years or so.

It is very unlikely the case would be dismissed for the error; it would be viewed as a scriveners error and the prosecutor can move to amend at any time.
