Q: Can I be represented by a court appointed attorney at any point in time during court? I represted myself in first apper

I was represting myself for first appearance and want to know if eligible for court appointed attorney, can I request at any time during the matter?

Yes you can always hire a lawyer or request a public defender. But remember you only get a public defender IF you qualify financially for one.

Q: How do I requested formally to change venues?

Ticket is from town a but cop is from town b and court is now in town b. Is there a formal way to request to change venue or a blank change of venue?

Q: If i got pulled over in a town by a cop outside of that town, get a ticket can I request to change courts on that reason

If an officer give me a ticket and court is from his township and not the town it o ccured can I request to change courts to where the infraction occurred?

IN general you can only change the town if you either know the judge or prosecutor or if the ticket was given for the wrong town.

I will leave you with this thought if you don't pay the ticket and fight it, the cop can always still file a ticket for the cell phone generally within 30 days and then you have to fight both tickets. If it was me I would just pay it and fix the light.

100% right giving a ticket is discretionary. In the US we have selective enforcement, otherwise almost every person driving on the highway would get a ticket for speeding.

That is not your problem as you do not need to be using your phone to get a cell phone ticket, just holding it for example is enough unless you fall under one of the exceptions. A pro se will rarely ever win a ticket in court as even most lawyers have a low success rates for cell phones tickets.... View More

Generally a ticket has a mandatory court appearance because the judge needs to set the penalty.

Q: I received a ticket for 39:6B-2. Is it possible for it to be thrown out?

I hadn’t received the new insurance card yet, but, the vehicle was insured at the time of offense. I currently have the insurance card to prove it.

If you show the insurance card to the prosecutor they will amend it to failure to exhibit a card which is also a violation but no points no loss of license fine only.

If you pay the ticket you will get a conviction for unsafe lane change, points on your license here in NJ and your insurance company will be notified. Also any conviction could also be used against you in a civil proceeding should the "victim" decide they were injured in a accident etc.... View More

Q: Does a NJ town have to give public notice of changing a stop sign to a yield sign?

For twenty years I have used an entrance onto a street that has always been a yield sign. It was changed to a stop sign with out any public notice and a sting set up to catch drivers who did not stop, but only yielded.

Not to my knowledge, they just need approval from the State DOT. However you also need to stop for all oncoming traffic for a yield sign. If you need to fight the ticket I suggest a lawyer.

I would suggest not. You don't want to come even close to that statute. Also NJ does have laws against using extra lights you can look them up. Remember Justia is not a legal service provider so we can't give you specific answers but you can google them yourself.

Unfortunately if you want to contest the ticket she will need to take a day off from work. By the way she does not need to be driving the car for a parking ticket she could have given the car for someone else to drive it in Jersey city and the wrong car make could be considered a clerical error.
