If an officer claims you failed to yield at a green light while turning left, it depends on the situation. Legally, when turning left, you are expected to yield to oncoming traffic until it's safe to make the turn. However, if the officer wasn't moving or there was no oncoming traffic, it... View More
If no marijuana is found but other evidence is found can it be used in court?
answered on Sep 22, 2024
If an officer claims to smell marijuana, they may use that as probable cause to search your vehicle without a warrant. The legality of the search depends on the circumstances, such as whether the odor was strong enough to suggest criminal activity. In many places, the smell of marijuana alone is... View More
But ended up giving me a dui because I refused the breathalyzer.
But the windows were of legal tint. Can I win and get it all thrown out?
answered on Mar 29, 2024
If you were pulled over for window tint but were not ticketed for that specific issue, it indicates the initial stop may have been justified under the officer's belief that a violation occurred. However, the outcome of being charged with a DUI because of refusing a breathalyzer is a separate... View More
The cop said the reason why he pulled me over is because the stuff in my truck bed he didn't think was secure but when we went thru the roundabout he say that is was so can that be dismissed

Potentially, but it is difficult to tell from the information you provided and it would require that emotion is filed.
Was given two citations for driving under suspension at my house without ever being pulled over by an officer.

Yes, an officer can. Will it hold up to the scrutiny of a judge or jury? That depends on whether it can be proven you were actually driving under suspension.
Does it matter if the parked vehicle is occupied?
answered on May 13, 2022
A North Dakota attorney could advise best, but your question remains open for two weeks. In general nationwide, the driver who hits a parked car is usually at fault. The fact that the vehicle may have been parked in an unauthorized space does not usually remove blame from the moving vehicle. The... View More

Insurance can find out before any judgment is rendered on the ticket, so you're out of luck there. Best way to get the ticket dismissed is to challenge it if they, in fact, cannot prove you were speeding.
Then on my first court appearance says he not absolutely sure it was me he seen driving. Why am I still having to go to court for this
answered on Jun 10, 2020
When you walk into the courtroom, the odds are often stacked against you. The answer here is likely that you need an attorney. The place to prove or disprove a claim is trail, not the first appearance.
answered on Feb 4, 2020
There are some larger issues with a traffic ticket that old. Specifically, whether you have a warrant for that ticket and whether any evidence even exists anymore to prove or disprove the claim. As soon as the case is opened, yes, you could likely dispute.
I got pulled over for expired tags. when they asked to search me I told them I had a knife on me. The cop said he ain't going to ticket me for why he stopped me but arrested me for misdemeanor weapon concealment charge. Was that legal?
answered on Feb 4, 2020
Maybe, it depends on the circumstances of the stop. Many lawyers, like myself, help individuals determine if their stop and arrest were legal.

A speeding ticket only? A lawyer may be a bit overkill in terms of price.

No attorney can provide you advice without knowing more about your situation. In general, you should plead "not guilty" even if you committed the crime as doing so will better preserve your rights. However, pleading guilty or not guilty carries serious weight and equally serious outcomes.... View More
The main error is that they said the location that it happened at was over a mile away from where it actually happened. And the date to appear was wrong and crossed of and rewrote. And in the year slot for my registration they wrote "K"

The simple fix is to hire an attorney. My usual approach is to assess the situation to determine if a client has a high probability of successfully contesting the ticket or cutting a deal. Generally, contesting a traffic ticket is not a high dollar case and the cost of doing so is well worth the... View More
