An Oklahoma attorney could advise best, but your question remains open for two weeks. Unfortunately, the insurance coverage is not retroactive. You would need to defend or discuss with an attorney defending the ticket/charge. Good luck

This is one for the insurance companies to fight out but if you turned into them and they were sitting still then most likely you will be responsible party because you are responsible for your car in movement and making sure to clear obstacles.

Q: Does the insurance have to total a vehicle if the repair costs surpass the Total Loss Threshold? Asking in Oklahoma.

The Total Loss Threshold is 60% in Oklahoma, the repair costs are currently around $25,000, the vehicle's value is around $37,000-$39,000.

Would they legally have to total it since it is over 60%?

Presumably they have an appraisers report saying there was damage. You have to prove their wasn't. Won't be that easy.

We don't have enough information. It depends on whether the insurance is through your employer and whether insurance payments are addressed in your separate maintenance decree or agreement.
