If you have an attorney already, it would be best to schedule an appointment to discuss your concerns in person with them.
If you do not have one yet, I would recommend retaining someone experienced with personal injury.

No points are assessed by the Virginia DMV for a violation of 46.2-830.1.
I got caught doing 90 in a 70 in hopewell va. I am currently taking a driving class so I can take it to court is this Smart. I have +4 on my driving record and printed out my dmv record which has no tickets on it. I am also hiring a local lawyer to help me as well. I am freaking out I plan on... View More

It is smart to do the driving school. At that speed, if you were to hire a local attorney, you would not need to appear in court (the attorney could go on your behalf). The charge is a criminal misdemeanor, so you should hire an attorney, or at least seek legal advice. I strongly believe that an... View More
How many day can I wait after getting speeding ticket? Am I gonna get extra charged?
answered on Jun 1, 2021
There should be information on your ticket which details when you can pay---I certainly assume that you can still pay now. That said, I would recommend that you contact a traffic ticket lawyer or 2 in the area/jurisdiction where the ticket was issued and find out whether or not they think you can... View More
I recently turned 18 and am about to graduate from high school with my associate's degree and a traditional high school diploma. I have received a speeding ticket for 59 mph in a 45-mph zone. The ticket says that it was due to a stationary radar. After doing some research on these radars, I... View More

Hire a lawyer to go to court for you they will know what to do. You look like you're getting bad information on the internet. Call someone who regularly practices in the court where your case is.
I received ticket for speeding and it is over 20 MPH. Officer told me that he marked it as a speeding not as a reckless driving. But still if you get ticket with over 20MPH it is going to be 6 points. I checked my driving record and it shows +3point. I don't understand how it shows +3 if I... View More

The ticket will not impact your record until after court.
When you initially get a license you have a 0 point balance. You get positive points for every year you have a license. Your +3 could be because you haven't had a license long enough to get 5 positive points.
The described charge is speeding 52 in 35, or is it just a speeding ticket then with the wrong Law section?
answered on Mar 25, 2021
Sounds like the officer may have accidentally filled in the wrong code section. As you likely noticed, 46.2-835 references turning right on a red light. Keep your court date as the judge is likely to allow the officer to verbally amend the error in open court. Contact a traffic attorney to look... View More
I got a speeding citation for driving 37 in a 25 MPH zone in Virginia. My only other ticket was in April 2019 and it was out of state (84 in 65 MPH zone). I did take a defensive driving class in June 2018 for a ticket dismissal.
In my circumstance, should I request the court/judge for a... View More

If you took a driving class for a dismissal less than 5 years ago, many judges will not give you the option again. Speak with a traffic attorney in your specific jurisdiction to see if there is any extra info you can give that might help your chances of a reduction or dismissal.
I live in Virginia and am buying a car from a state that did not require front license plates. There are no brackets or holes to mount a plate. Do I need to "alter" the car to accommodate a front plate or is their a provision for this situation?
The ticket was issued in Norfolk, VA and when I log into the website to pay the ticket I do not see the ticket. Am I off scotch free or what? If I am not off scotch free then why is it not in the system and how do I pay it?

I want to request a later date due so I can afford representation
answered on Jan 17, 2021
Yes, court dates can be adjusted to allow time for you to save up to afford a lawyer. Depending on the county, jail time or suspended jail time may be a possibility. If that's the case then the court would have to appoint a lawyer to handle your case for little or no cost to you. Regardless,... View More
I don’t feel like I was going 49 since I was driving with my cruise control at 40. I don’t know if I should just prepay this and take the hit or go through with the summons the officer gave me.
answered on Jan 18, 2021
It sounds as if the officer was trying to cut you a break instead of writing you for speeding. It depends on the code section he/she used. No one here can tell you what's in your best interest without knowing more about you such as your driving record but even then it would ultimately be... View More
The officer wrote II in the law section on the summons instead of the number 2. The two previous people before me had the same offense that i had (wreckless driving) but had their cases dismissed due to the this error. The judge then told the officer that he could make an addendum to my summons... View More

Most judges I know wouldn't dismiss for writing roman numerals vs. the actual number. The judge allowed it and I don't see that you have any remedy beyond appeal which may or may not be a good idea.
Was stated a laser caught me going 58 in a 25. However, he put I was driving a Chevy and I was driving a dodge. The color , year, and plate is accurate. Will this get thrown out, due to incorrect information?

Would also like to know if the charge is reported in national federal
searches if you’re not convicted of the charge? Does the charge show up on a global entry background search?
answered on Nov 10, 2020
I don't know that anyone here could answer this concretely for you. Government background searches are the most in depth. If you weren't convicted, it more than likely won't show as a ticket (summons) is not considered an arrest. Prior arrests do show on background check but these... View More

Usually no, especially if your license number is correct and the name is close. But if the license number on the ticket comes back to Tiffany Johnson and the name on the ticket is Michael Smith then you've got a potential defense.
I'm 16 and got my license like 3 weeks ago. Was following a cousin down a road i didnt know, speeding ~10/15 over limit and took a turn too fast and crashed. No one was hurt, car was totaled, and sherriffs said they wouldn't have written me up for it but had to call a state trooper (i... View More

You should have a lawyer represent you to help get it dismissed. Driving school goes both ways. Some judges get mad if you do it before and some don't want the reason as voluntary. A lawyer who goes to that particular court will know the local rules. A good lawyer will know there is a... View More
So I got pulled over for speeding in October and my court hearing date is set for November and I’m trying to pay it online but can’t find my case? The yellow piece of paper the police gave me doesn’t have a case number so I’m down to use only my name and hearing date and time and I’ve... View More

I'm not sure why you would ever want to pay a ticket because you're pleading guilty and usually the insurance would cost more eventually than paying the ticket.
I would call a traffic lawyer in that area.
I'm a 19 year old male. I was pulled over for speeding back in May, but the officer let me off with a failure to obey a highway sign. I went online and paid it since it was a simple moving violation. Already got the case continued twice due to not having money for a lawyer but still don’t have the money to afford a lawyer. I’ve spoken to lawyers and kind of know jail time is pretty much guaranteed. What should I expect with jail time and my license?
answered on Oct 13, 2020
Every court and every judge is different and at different speeds. 100+ is too general. I've seen people (not my client) get 30 days in jail at 95 mph and I've had clients get no jail at 121 mph. I recommend borrowing money to hire a good lawyer.
