I’d search it back further than 1961, but if there’s no easement, they have no right to enter or use your property.
I’ve lived there for three years and owned chickens they whole three years and are now telling me I have to get rid of them new ordinance passed may 2nd this year

You pose an interesting question, but the response would largely be a matter of personal opinion. You could pose the question to employment attorneys, as they would have the most insight into this issue, more so than attorneys practicing in internet law and agricultural law. Good luck

Your analysis is correct. The first statute applies only to people. The second one applies to animals, although if there is justification for doing do, it would probably protect you against a civil claim.
