I’ve been on child support 2 years for 2 kids do I get to claim one of them or both? She has not let me claim neither. Is she obligated to allow me one for taxes or both?
answered on Jan 25, 2019
No, you cannot claim either. The IRS only allows the custodial parent to claim the children.
I used to pay child support through a local organization in a Canada (we used to lived there and after divorce she moved in with her parents in Atlanta, GA). A few years after divorce I moved to another province so the organization contacted the both of us saying since neither of us live in that... View More

If your support order originates from Canada, you should consult with an attorney in that jurisdiction to determine any statutes of limitations on your obligation to pay. Generally, if you have a mailing address or deposit account information for her, you should attempt to send the payment via mail... View More

There is no way for someone to know that without knowing more about your case. It is possible you overpaid and it was improperly withheld. You need to be the one to keep track of what you owe. Do not count on them to do it. They can make mistakes, just like everyone else, and if you are not... View More
He has a learning disability, but will graduate high school in 2020.

The order should state that child support ends at age 20 if the child is still in high school.

Why not file for divorce and enforce your custodial rights as their mother? It is time to act here.
I have petitioned for legitimation around the time that adoption petition was served. My child is 10 years old and I was never married to custodial parent. Please advise.

You probably want to get an attorney for this situation. Is it possible? Maybe. I would need more facts before giving a true assessment. You have a complicated matter and representing yourself would not be wise.
back almost immediately after the order was filed, do I have to pay for a modification? The paperwork is vague and doesn't state how to handle.
answered on Jan 14, 2019
You are asking for specific advice about an order that we haven't seen that you yourself say is vague. The only way to get advice about this issue is to go see a family law attorney, and have them review your order and give you advice.
received a travel deviation for her support amount. She has been staying with a friend in Georgia ever since the final order but won't admit it. She lives right down the street from us. She was ordered to pay $305/month with a $200 deviation...making her payment amount only $105. (She... View More

You probably should do nothing. The travel deviation probably isn't enough to spend thousands in attorneys fees arguing over a few dollars in child support. He got custody, which was the most important thing, so sometimes it's best to leave well enough alone.

If you are having trouble getting legitimized through the court on your own, it may be your best bet to save up your resources to hire an attorney. I recognize that lawyers are expensive, but we know the legal process and are often able to cut through a lot of the red tape to get results... View More

I don't know if this is an immigration case in any respect but as I am a Georgia-licensed attorney I will advise you to call the State Bar of Georgia in Atlanta and ask for their Lawyer Referral Service, and then ask for help with a family lawyer in Greene County. Your best option may be in... View More

That is a complicated scenario and you should consult with an attorney. Two child support worksheets would have to be done. If 1 lives with the father and 2 with the mother, AND the father makes equal or more than the mother, then father would probably pay something, but it's best to have... View More

If you have concerns with the child's safety while with the mom, you would need to petition the court for custody or for a modification of custody if there is currently a custody order. You should consult with an attorney as soon as possible while the allegations are fresh.
Can she take him to child support recovery if he is not in the system for it and he is always paying it on time.
answered on Jan 3, 2019
Yes, she can file for support if she chooses to.
Since she’s reached one of the two requirements am I done paying? Her mom is incarcerated & is telling us she’s owed until 20. It says in the decree “19 or graduated from high school.”
answered on Jan 3, 2019
Follow what the decree says. You were there, I wasn't. I cannot tell you why it was written that way. It is unusual, but the plain language of the order is clear if that is what it says.
In Ga do I have to file anything? I’ve been told it terminates in Ga at the age of majority?
answered on Jan 3, 2019
Your decree is what controls. If that is what it says, that is what you do.

You can register and enforce the order in Georgia. An attorney can help you with this.

Yes, but he still has to pay the child support order.
My child was taken from her mother by DFACS. I hired an attorney and lost basically due to the fact that I’m a single father and my job requires me to travel often. The court ruled that my daughter was to live with her grandmother ( my ex’s mother). I’m still paying child support to my ex... View More

You need to file a modification action to address the child support issue if the mother no longer has custody of the child.

If she lives in Texas, you need to speak with a Texas attorney about the process for legitimation there.

Sounds like you probably missed a hearing. Talk to an attorney and provide more information about when child support started and where the order came from.
