I have my son everyday but he sleeps with his mother during the week. I provide him with food, clothing, etc. She has a higher income than I do. I also have a new born with my current partner would this play a role on how much i pay for child support?

No back support. Yes, she can file for cs. And a parenting time schedule can be put in place. The circumstances of ur older children, unless in college, do not have any bearing on this one.
My husbands ex is taking us back to court for more money. She is telling us she should be getting atleast $100 more a month. She told him how much she makes and then she also gets money from her older sons dad's SS since he passed away. She told us that she does not have to claim that in the... View More

Ishe has to claim it as part of her income but that amount does ot decrease your husband's responsibility.
homeless and has no job. I recently found out he's been doing temp jobs and trying not get a real job because I filed for child support. Is this true he doesn't have to pay because its a temp job?

I believe the minimum is $40/mo. U have to prove his income. Its hard to do.
We have 50/50 custody but i moved to IL and before I left we had a verbal agreement that I will send her money every 2 weeks for my 2 girls. Also for taxes she will report one and I the other. Since 2007 when I left everything was good I sent money every 2 weeks even for extra things and taxes... View More

You r liable for child support for your daughter on birth certificate til she is 18. She can file for c.s. forward, not backward. It is based on your curent income but could be averaged if u have a job that fluctuates.
The child stays with his grandmother and she receives no support from the mother who has been in and out of the penal system for years. I just found out he was my son and now I am required to pay child support. What are the responsibilities for the mother in this situation? Can we be made liable to... View More

Looks like she is using grandma for permanent babysitting.
You can go to court to ask for a Parenting Plan favorable to you since mom does not want to be involved.
Also if I owe her money due to not working would she be able to forgive my debit so I can start off fresh?
answered on Jan 15, 2018
If the money is not owed to the state, you and she can pretty much work out whatever you want.
As long as it is not unconscionable.
Nothing counts until a judge approves it.
Child turns 18 in June after graduating high school. Court order says that i am to pay x amount of dollars on minor child(ren) and that my ex and I will split secondary education costs. There is no exact end date on the court agreement. Does the child support stop after the child is 18 and... View More

Your best bet is to go back to your attorney a month or two before the child's 18th birthday and have them file a petition asking the court to set a specific cut-off date for the support. You may still be liable for the expense of secondary education, but you will have clearly established when... View More
Son also had repossessed car he had bought for ex she stopped paying for after she wrecked he kept wondering why he was still living paycheck to paycheck, company had payroll change that's how they caught it, she owns her own Nail salon but keeps giving him the run around.

If there was only one child and he was paying support and the child died, he needs to go to court to terminate it.
As to the car, depending on how the divorcement reads, she may be in contempt for failure to make the payments.
I understand they will order a DNA test, however, if he is my baby’s father this will mean he raped me (he admitted in text I was blacked out drunk and assumed I was on birth control) and didn’t tell me he was not safe. How likely would it be that he can get rights to my baby? I was already 35... View More

You need to see a lawyer ASAP. You're right about a DNA test being necessary. If you haven't deleted the text message yet, be sure you keep it. The public policy of the State of Illinois favors both parents having a relationship with a child, so yes, he may have rights. Off the top of my... View More
He stopped paying me in may and we just went to court today but support was not discussed just focus class and mediation. But I would at least like temp support until our case is over and it’s been almost a year already. Can I ask for back support and how can I receive something now?
answered on Jan 10, 2018
No back support without court order. File a motion for temporary child support.
He didnt really help me with any spences when we where together. Thats why we went our separate ways. I also want to file for a divorce.
answered on Jan 9, 2018
Talk to a lawyer about filing the divorce. He or she should include a request for child support, so it can all be done in the same proceeding. You can get temporary support paid during the time the divorce is working its way through court.
I have my daughter 143 overnights my ex husband got mad at current employeer and stormed out of his job. Since he is more than capable of having a job will this go into play. I feel as if he only wants her to get money out of me like when we were married.
answered on Jan 8, 2018
As a general rule, the courts will impute income to a parent who manipulates the system to reduce or eliminate their income. In other words, if the ex was making $500 per week and quits his job without a valid reason, the courts will treat him as if he continues to make $500 per week when... View More

Child support and visitation (now it is called parenting plan) are two separate issues.
He recently switched jobs and is required to supply me with pay stubs and a tax return but he has informed me that the job is paying him cash and that he has never filed a tax return(he is 33).
answered on Jan 4, 2018
I don't know if you are working with an attorney or not, and I don't know if you are married with him or not. I would suggest that you should consult with an attorney, either a private attorney or the State's Attorney.

The court, at its discretion, will either dismiss or strike the underlying petition or motion, or it will continue the matter to another date.
I have a case in IL involving my now 18 year old daughter. Her biological father is over $48,000 behind and hasn't paid anything since 1/3/2017. I have called child support enforcement and all they will tell me is they sent him a letter because they have no employer on file. I informed them he... View More

You ought to hire a lawyer to file a Petition for Adjudication of Civil Contempt. Bring a copy of the most recent court orders involving child support to your first appointment, together with payment records of what you've received. If you don't have the payment records your attorney can... View More
We already have a child support order established but have to go back to court Janurary 24th to discuss child care expenses. He now states that he is going to file for joint custody or visitation. Illinois no longer has custody and visitation.
It has parenting plans which spell out responsibilities of the parents and who has them and when.
If you two cannot agree, the court will order mediation and if that doesn't work, hold a hearing and decide.
Look at the... View More
My daughter is 4 and her biological dad is not involved and doesn’t pay or buy her anything
answered on Dec 29, 2017
If you want support you've got to go to court and ask for it. To get it you'll need to prove he's the biological father with DNA tests, unless he admits he's the father in court. The court can order the DNA tests be taken.
If he is found to be the father the court can... View More
