Not sure of your question. If you didn't have one, you can be ticketed for that even if you were not at fault. However if you were not at fault and injured, you need to protect yourself and your access to care by seeing a doctor--the medical benefits in a wreck last for 4 years plus, no... View More
I have a police report, my insurance is going to contact her insurance, If She doesn’t have coverage, what can I do to make her pay?
answered on Jun 17, 2021
Please see my answer to the last question. Assuming she has no coverage, mention that to the police. They will cite her, and that may, miraculously, cause her to produce the "oh, I forgot about this...is this what you mean?" policy she didn't want to involve in her misadventure.... View More
My Insurance is going to contact her insurance, but they told me that they have to find if She has coverage. I’m using my insurance, but I have a deductible of $500, can I make her pay everything that I spent? The police report shows that is her fault, what can I do if She doesn’t have coverage?

Q: "can I make her pay everything that I spent"
A: Depends whether what you spend is legally recoverable. You definitely would be entitled to your deductible. In almost all instances, you are entitled to towing from accident scene to your house and/or repair shop. You are... View More

property damage. If you hade injuries that's a claim against his insurance unless he had none.
This will be a soft glow not nearly as bright as any headlamp or a flashlight even. I've read that in California they do not allow underglow (which is a type of lamp) to be red or blue. I also think if I read correctly that Pennsylvania doesn't allow lamps period, however I have read... View More

Don't see why not. Ask the police--they're the one's you'll deal with. (You can't take their word as gospel but I didn't find anything saying you couldn't. Note however that many glow in the dark paints do not adhere well to cars.

The issue is you rear ended him. Unless you have a good reason why you didn't see him slow or stop, you don't have a right to assume that he is moving if his brake lights are on. You have to maintain an assured clear distance, which means as he was slowing you have to slow. I haven't... View More
11/2020, son was involved in minor parking lot auto accident- backing out of a parking space in a corner lot when a man driving a company truck cut through the lot to avoid a traffic light causing a minor collision. You (and your insurance company) are responsible for damages caused in the collision only if you (in this case your son) was at fault in the collision. Additionally, the person claiming damages has the burden of proof of more likely than not to show that the damages he asserts were caused by the... View More

Yes, you can sue (or perhaps first make a claim) against the at fault party and her insurance company for the property damages to your parked car.

The insurance company says they only have to pay my deductible since I have collision insurance. This doesn't seem right.
answered on Apr 8, 2021
You are correct, it does not seem right. You should search for a personal injury/accident lawyer in your area to discuss this further, especially, if you have physical injuries. Most lawyers in this field will provide a free initial consultation---contact a few of them, discuss your matter, and... View More

What kind of claim are you trying to pursue? If the claim is for negligence, i.e. for damage to a vehicle, property, or for personal injury to your person, you have two years from the date of the incident to either settle your case or to file suit against the responsible party.
My lawyer said they overlooked the bill which they had for over a year. Also, it was a doctor he sent me to, so in a sense it was his doctor.

It's difficult to give you an accurate answer without some more information. For instance, did you and your attorney sign a letter of protection for this particular provider? If so, I'm not surprised your attorney is seeking repayment to the doctor from your settlement. If there was not a... View More
Driver hit my mirror with his. Shattered his but only folded mine back and kept driving. Based on what you've described, he could probably be charged at least with a traffic offense for something like careless driving as you suggested, but if he didn't cause any damage, the police may not be too motivated to pursue charges. I would consider making sure there was in fact no... View More
I backed up into a postal service car in the court that I live in. I had only lightly tapped her front end before seeing she was there. No damage or injuries were brought to the car or driver or myself. Her work managers were called and so was 911. A state officer was the one who came to check it... View More

Fortunately no one was injured and there were no damages. Unfortunately, often times citations will be issued following a motor vehicle accident, however slight. This is a trend that has seemed to increase in recent years, at least in my experience. You should contact a local attorney for a free... View More

A Pennsylvania attorney could answer best, but your question remains open for four weeks. As a general matter, if you've gotten to the release stage, it seems unlikely that they want to see your entire medical history, hence blank authorization for your account. It seems more likely they want... View More

The lady's insurance company is saying they only cover up to $5000. I just want to know how that works with multiple cars being hit.
answered on Jul 7, 2020
The proceeds of insurance get prorated among all the people with claims, based on the amounts of the damages to each car. In all likelihood, there would not be enough funds for you to fully cover your claim, and you would then have to resort to your own collision coverage, if available.
can the officer testify in traffic court to the violation he cited for?

You should get a lawyer because chances are you are looking at some points. Another option is to negotiate the ticket with the cop and try... View More
