You cannot withdraw your guilty plea but you have 30 days from when he fully with need to file an appeal in the county court. You will then get a new court date. Get a lawyer to represent you so hopefully you can get your points reduced. You will get a letter from PennDOT shortly that imposes... View More

Q: Cited for going 66 in 40 mph zone. Should I sign up for Traffic School to reduce points on driver record?

Officer told me I could ask for speed to be reduced at Magistrate. Should I sign up for traffic school, pay fine and plead for mercy to reduce points?

It depends on the judge whether you should go to traffic school or not. Your speed is a five point major violation but it is not too terribly fast so that’s why I believe traffic school is optional. It is definitely worth it to go to court to try to get the points reduced and also, many judges... View More

Q: Does an officer have to give you a ticket on the spot?

I was pulled over for running a stop sign. I know I stopped and my passenger confirmed this as well. The officer did not ask me to sign anything or give me a ticket. It is not uncommon but the citation must be filed within 30 days. It is a 3 point offense on your record so it is worth it to plead not guilty. Many judges will let your lawyer go to court for you so you may not even have to attend the court hearing to get your points reduced. Good luck!

I can for certain that if you have a Pennsylvania license, you will not receive any points for that section. That may vary if you have an out of state license, but I have never seen that section result in points even for an out of state license. Best wishes.

Get all the paperwork in the docket for #1 & #2. Make copies and keep the originals.

If service of the complaint for #1 is identical, then it is an error. If he refiled for some reason and that was served on you then the issue is one of non response.

Not sure why your license...

He felt he was doing you a favor as hit and run is at least a misdemeanor, and can be a felony. It's very serious.

You have to look at the section. If it's a stop sign violation those are no points for the first offense. If it was a control signal, that is points but it's not...

You need to speak with an experienced traffic attorney. If a judge sees that your license was suspended at the time you were pulled over then you will most likely be found guilty and lose your license for an entire year. Hiring an attorney would be a wise choice

Q: I got pulled over for doing 84 in a 55 he gave me a break and fined me for failure to obey road signs so i wouldn’t get

Frankly, if there are no points you are better off paying it. Judges tend not to favor those who already got a break, and if you were doing almost 30 over or even 20 over they will consider it a monster break.

I'm not sure how you would fight it without the judge knowing that it was...

I had to get the ticket in the mail because "their system was down" when I got pulled over. Small things like the color of the car won't get you off the hook. Only 5 over, is something you can fight though if the Judge gets the idea you were actually going 16 over they may sock it to you. Was your correct address on your license because that is likely where it was sent. Call a lawyer as it can be checked online.
