Q: Do I still have a chance to get off with drivers school since this is only my first offense?

I was pulled over in Rutherford County. The Rutherford County driving qualifications says that the speed must be no more than 20 over the speed limit, but I was going 25 over and got ticketed. I am a minor.

This is your second question on the issue. A lot of lawyers offer free consultations. Judges have discretion to lower speed - but you should really consult with an attorney. Ask you parents to help...no shame in that.

It may mean that the police officer recorded the stop. Without seeing the citation, hard to tell. Consult counsel.

You need to make sure that you get a court date and you need to confirm that date by calling the clerk's office. You can retain an attorney to defend the ticket. Otherwise you can choose to have a trial, or plead guilty and pay whatever fines the court. But if you do that, or are found guilty... View More

Q: What can be done about a ticket for an illegal lane change and phone use (not texting) in the state of Tennessee?

There was a driver acting like they were going to rear-end me after I passed them. Once the 2 lanes went to 4 lanes, I got over in the left lane then slowed down and got behind the vehicle to take pictures of the tag. I was pulled over for an illegal lane change and phone usage, but in the report... View More

You could appear at a trial and plead your case if you have some defense. Or choose to pay the fines associated. Those are your options. But you may face points on your license if you pay the fine and/or show up to court and plead guilty or are found guilty.

If it's a parking lot not sure they can ticket you. Worth it to save on points to at least get a consultation from an attorney who handles traffic citations in the county where your citation is from.

For now, plead not guilty.

Q: didn't turn driving school papers in before ticket was due. They wouldn't let turn in and had to pay ticket now.

My son accidentally forgot to turn in papers before ticket (speeding ticket) was due by 3 days. He was going to take them by next time he was in Johnson City. We live 30 min. away. He was leaving them sitting on his passenger seat so he'd remember to run the paper by. When he cleaned his car... View More

He could have taken care of this, but he chose not to. Allowing someone to do driving school to keep a ticket off their record is not a right, it is an agreement between your son and the State. He didn't follow through with his part of the agreement, so they no longer have to honor theirs. He... View More

They can unless you prove it was not you driving. If you fail to show up and fail to defend, there will be a fine issued and court costs. I don't know if they can suspend your out-of-state license for an offense in Tennessee. What you definitely want to avoid is getting a warrant for failure... View More
