Q: Is at fault insurance company liable for storage fee's for disabled vehicle that was towed to owners home sit 65 days?

They really took their time, first saying that my vehicle was totaled, after 2 months they changed my adjuster the new person said that it was not totalled and I would be issued a check a few weeks later I received the check and it was towed to the body shop.

I do not quite understand your question----if the vehicle is stored at the owner's home, then there's no storage fees incurred for that time period. If the vehicle is at a tow/wreck or 3rd party facility, then more information is needed---I suggest you contact an accident/injury lawyer... View More

What kind of belt is it that it needs? Is the vehicle an old model? There does not seem like a valid reason for your vehicle to be in the shop for 9 months. Is there any more information you can share that will help provide an answer to your question.

It appears your accident happened in California, according to news reports I've found. If so, you would need to speak with an attorney licensed in California. This question board is for Louisiana.

A Louisiana attorney could advise best, but your question remains open for three weeks. An attorney might need more information to determine what is going on - it sounds like you might have a wage lien that is accumulating. That's only a general guess from the weekly reduction you mention. An... View More

Q: Does Louisiana’s no pay no play law exclusion for legally parked cars apply if the driver is not in the car.

I had insurance on 2 of my vehicles, I’m not sure why the 3rd wasn’t on there. I was in the hospital having surgery and someone backed out of the parking space next to my car swiping the back corner, my taillight and scratched my bumper.

No, if your vehicle was legally parked at the time of the accident, Louisiana's “No Pay, No Play” law does not apply even though you were not carrying insurance.

That's 2 different scenarios with 2 different answers (most likely). The operator of the vehicle (and not the owner of the vehicle) would be responsible for any tickets issued assuming the ticket is issued to the driver. Likewise, the operator of the vehicle (and not the owner of the... View More

You can submit this to your insurance company---if your insurance company says that you have coverage then they will handle it. If they say you do not have coverage, then I would contact a lawyer (or 2) and sit down and discuss the specifics of your situation: (1) whether you have claim against... View More

Q: I was in an accident, and the citation has lots of incorrect information. For example my birthday is off by 20 years.

My age is written incorrectly, I do not believe the statute number does not exist, and I also believe the officer was supposed to write down the vin number to my vehicle. There was also another section that was not filled out.

It would depend on the wording of the contract between the client and lawyer. Most contracts state that the fee is a percentage of "all amounts recovered."
