Q: My heater set off the carbon monoxide alarm. Can I leave my lease?

When we moved into our apartment the heating didn't work, when we turned it on the unit caught fire. Our landlord sent out a repairman after many months, who "repaired" the unit to the best of his abilities. My roommate when to bed that night. He was awoken at 6am the next day to the... View More

Although you have posed the problem, you have not asked how to solve it. It sounds like if the heater can catch on fire, and the unit emits poisonous gases, you might want to simply move out ASAP. Signs of problems like that usually indicate more problems with the unit. You can ask the landlord... View More

Q: My lawyer doesn't want to go to trial even though this is our request.

We are not excepting a low ball offer being handed to us by the insurance company. We are refusing it and our lawyer has turned in to something really bizarre, almost flat out refusing to file for going to trial. Siting his "reputation" and losing??? Being very aggressive and combative... View More

Many lawyers (in fact most lawyers) hope to settle a case without going to trial. I myself practiced personal injury law for 30 years, and hoped that I would not have to go to trial. That's because trial is very expensive, and forces the attorney to spend a lot of money in preparation for,... View More

You need to get your medical records and review them with an attorney. If he did the wrong surgery on you, you have a good malpractice case against the doctor and/or the Hospital. You should call a good personal injury lawyer and discuss this with him or her.

The easy answer is that you can find out what your rights are on the internet. Just look up a website called "Dogs for Better Lives." Their website is www.dogsforbetterlives. They provide a lot of information.

I assume that an "ESA dog" is an "emotional support...

THE CHURCH OWNS THE HOME I AM STAYING IN--THEY WANT US TO SAVE MONEY-SO THEY TAKE A MAJOR PART OF OUR MONEY AND PUT IT INTO THE CHURCHES SAFE DEPOSIT,IS THIS LEGAL?THEY ALSO HAVE ACCESS TO THE NUMBERS OF OUR BANK ACCOUNTS,

If the Church owns your home, then I would guess you are renting the home from the Church, and paying rent to the Church. That gives the Church certain rights over the home, but I don't think they have the right to save your money for you unless you gave them that right. The same goes for... View More

It sounds like you were not properly supervised when you were released. However, unless you were injured when you were released, you do not have a claim for damages. Discrimination is a difficult thing to prove, and to bring a claim for discrimination is very costly and time consuming. I suggest... View More

It all depends on what the contract says. You need to review the contract and see if there are provisions for terminating you at will or for cause; and you need to know how long the contract was for. They may or may not have breached the contract depending on the terms. There are probably many... View More

Q: Can my landlord tow my car?

I moved to California from Texas and my Texas tags on my car have expired. My landlord sent me a text saying if I didn't clean my car, she would have it towed out of my spot because of my expired tags. I park my car in a gated garage/car port that I pay for. Can my landlord tow my car out of... View More

I can only guess the answer to this question, so here it goes: I think your landlord could have your car towed due to the expired tags. The best solution to this problem is to register your car in California as soon as possible, and avoid any towing issues. As to the car being dirty, you should... View More

Q: I live in California and i’m month to month on my lease

I live in California and i’m month to month on my lease, have been for the past year. Today I get a note on my door, printed out from Microsoft word (in broken English) saying I need to add $30 to my rent every month for pet rent. Is this allowed? Do they need to give me proper documentation?

Assuming you have a written month-to-month rental agreement, a landlord can change the terms of the agreement (e.g. increase the rent) upon giving you 30 days notice. You can either accept the additional $30/month in rent, and continue living where you live, or you can leave within 30 days and... View More

It depends on whether or not you have a lease or a rental agreement. If you have no written agreement, you would be a month to month tenant, or a tenant at will. If you have a written month-to-month tenancy, they could give you a 30 day notice at any time. If you had a lease for more than a... View More

According to the contract, you are entitled to get the dog, since that is what you paid for. You do not have to accept the $2,500 "refund" from the seller. You have a right to "Specific Performance" of the contract by the seller. That means you can go to Court and force the... View More

Q: My contractor's project manager advised had me write out the checks under his name. LAPD told me to sue the company.

I hired a licensed contractor who sent me their project manager (PM). I signed a contract 178K. First check went to the company. There are a lot of unknowns in your question, such as what project was the licensed contractor hired for. Basically, the answer to your question depends on who at the company is in charge. If the PR was an employee of the company, and was cashing the checks for himself, then he has committed... View More
