Q: Please explain why my son is required to go to court, rather than paying the ticket and having insurance deal with it.

My son arrived in Lisle, Illinois for school just a few days ago, and will return to Massachusetts in 3 months. He received a citation today for "failure to reduce speed to avoid an accident." He was distracted and hit the car in front of him when traffic began moving. Why is he required... View More

Unfortunately, those are the rules. However, it is certainly possible for an attorney to appear on his behalf to address the situation. We often must appear for our clients in DuPage County because they reside out of state or for a variety of other reasons. As Mr. Harvatin indicated, the ticket... View More

It would be best for you to speak with your attorney in North Carolina who should be able to explain the delay and options at this point. As the case in pending in North Carolina, you may want to submit this question under NC rather than IL to receive responses from attorneys licensed in that state.

Unfortunately, you would need to go into the Clerk's Office in person to obtain the information if you can't get through via phone, which is often a problem.

Q: Hello, under what circumstances is traffic school required for a speeding ticket with court supervision?

I recieved a speeding ticket for 22 mph over the limit. I have what I think is a decent driving record. Im 32 and haven't had a speeding ticket since I was 17. I plan on asking for court supervision, but was wondering what the probability of having to do traffic school was.

It depends county to county and judge to judge. Oftentimes, it is not required for a minor speeding ticket if you have a good driving record.

Q: If I missed my pay or appear date for a DUI, then I went to jail for it, can I avoid going to jail for contempt?

I already had a warrant and went to jail. Now I have to go to court for contempt. I paid my bond to get out until my court date. I also paid an extra $50 towards my fine directly after I got out of jail. What else can I do to stay out of jail?

The best advice would be to complete any remaining conditions as soon as possible (payment of fines, etc.). Have an explanation, not an excuse, for anything that is left unresolved. Contact your DUI attorney.

Q: Got caught speeding 50 in a 25.

Should I just plead guilty? I'm so scared. I've never been in this much trouble before.

Luckily 25 mph over the limit is still a petty offense (non-criminal), while 26+ mph is a misdemeanor. You may be eligible for court supervision to keep this offense off of your record. Depending on your age, it may require completion of traffic school.

Q: How to read type 55 court supervision end date from my driving abstract.

I had received a speeding ticket in Sept 21, 2019. When I pulled my driving abstract I see that there is a field SUP-DT (sounds like supervision start date) of Sept 30, 2019. Q: Can I get out of paying traffic ticket if judge forgot to have me sign the court order?

I recently went to court for improper passing of an emergency vehicle (officer stated “you got over but not far enough”). It is a pretty hefty fine. It depends on the agency where it was completed. If it is the designated agency for the specific county where your DUI is pending, it should be sent directly to court. For example, if it was Central States Institute in Cook County, they will send a copy directly to the courtroom on your next court... View More

Q: Hi. Is there anyway to get old traffic tickets waived? I have a $700 no Insurance ticket from 1997 I need to pay.

It may be possible to file a motion to vacate and bring the ticket back into court. If you show proof of new (after acquired) insurance the fines may be reduced. It will not be dismissed unless you show proof of insurance from the date of offense in 1997.

It sounds like there was a miscommunication somewhere along the line or there is a misunderstanding. It takes two 'serious' moving violations (i.e. speeding 15+) in a commercial vehicle within 3 years to cause a CDL disqualification. It would take 3 moving violations in your personal... View More

Q: I live in Missouri. I am 52 years old with nothing on my driving record for at least 13 years. Bought SUV and got

no insurance ticket hours later heading home. One month ago I received a car as a gift for my girlfriend and I. We put her plates on it to drive it home and got ticketed for that. Both tickets occurred in Illinois. Court for both is next month.

Bring proof of the new insurance and the new registration to court. You should be eligible for court supervision and a fine, which would prevent a license suspension.

You will need a parent or legal guardian present if you are appearing in court. If you are just paying the ticket for a conviction you likely do not need a parent present. You can confirm with the Clerk's Office.

You should appear in court to try to keep the ticket off of your record with court supervision. You will likely need to complete a traffic safety course. It only takes two convictions within two years to cause a license suspension when you are under the age of 21.

Q: How to reduce the fine or dismissed ticket for driving with no insurance?

I bought a used car around 7pm and got pulled over around 1230am on the same night and apparently I didnt know that you can buy insurance online because I thought I wanted to wait the next morning to call the insurance company. The very next morning, I purchase the insurance.

Bring proof the of insurance to court. You will likely receive court supervision with a fine. That will prevent a license suspension but the Secretary of State will then require that you obtain SR22 insurance.

It is likely that the unpaid ticket is impacting your driving privileges. You can speak to the Secretary of State's office to confirm the specific reason for your suspension and whether there are other issues that need to be addressed before the suspension is removed.
