Q: We are separated, my husband has our son with him that is 15yrs old. He won't let me pick him up to see him.

So what can I do until I can get a attorney

to be able to have time with my son. Plus he wont let him go to FL on vacation to see my family and my son told me he wants to go. How do i go about havijg rights over someone who is manipulating and acts like a narcissist?

If you are not in Court on this and there is no divorce filed you can't do much. THe husband/father has as much right to him as you do. Get into Court and you can ask the COurt to decide what to do.

No. THe child support calculation takes summers with children into account. He keeps paying.

Q: Their dad has been screaming and spanking kids more. They dont want to go anymore because its constant. What can be done

My sons father has been more verbally abusive and has been "spanking" my youngest for any little thing. My oldest son who usually looks forward to seeing his dad no longer wants to go and I'm afraid they are being mistreated. Is there anything I can do?

You can gather facts that show that the father is mistreating the children and go to court to modify his parenting time with them. You CANNOT withhold the children or let "them decide" if they want to go.

You file a divorce, serve the other person and go to court and try the case. The judge then decides who gets what in terms of child custody and support, assets and debts.

Q: I’ve paid about $21,000.00 over since order for child support should have terminated. I cannot get them to stop deduct

The payee is incapacitated non responsive with a stroke and cannot be served. I don’t have money to file in court or get attorney

Can’t somebody stop the automatic deduction?

If you have not filed anything in court you can't get that back pay taken off. He or is court appointed guardian or conservator has to make a court filing. That's the only way it can be taken off. JPC

Q: Am I able to get paperwork from the school?

If my ex has primary legal and physical custody of our child, am I allowed to get proof where he is enrolled in school? Is the school allowed to give me that since I am his father? I do have visitation rights.

You should have full access to such records if you have joint legal custody. If you have no custodial right you can't.

FIrst, she was not forced to agree to a safety plan. She could have refused, and they would have probably picked up the child. You can't do things on the side, without the Court being involved. You don't have to follow the child relocation act if paternity AND visitation has never been established in Court.
