The answer is that technically, you probably cannot retain a lawyer on your own for a couple reasons. I assume you are trying to keep this whole situation from your parents, but in order to enter into any contract in Pennsylvania, you must be 18 years of old. That includes any sort of fee agreement... View More

Q: PA driver broke his mirror on my parked car No cars around. I got tag # Police said nothing happened here. Chargeable?

Driver hit my mirror with his. Shattered his but only folded mine back and kept driving. I happen to be sitting in the vehicle and there was no other vehicles around so I drove to follow him and he tried to elude me while I had 911 on the phone. I got his tag number and the state police showed up.... View More

Based on what you've described, he could probably be charged at least with a traffic offense for something like careless driving as you suggested, but if he didn't cause any damage, the police may not be too motivated to pursue charges. I would consider making sure there was in fact no... View More

Q: Do I have to provide opposing counsel with documents that have nothing to do with the pending case.

My case is for equal pay and retaliation and now after providing excessive amounts of documents, opposing counsel is requesting access to all of my medical records. There is nothing medical related to the case therefore do I have to see sign the HIPPA release?

Typically, you do not need to provide medical records if your medical condition is not part of your claim. Realistically, an attorney would need to know more about your case to determine if there is any reason to obtain your medical records. If you do not provide a signed HIPAA authorization, they... You always have the right to plead not guilty and request a hearing. Ultimately, it will be up to the judge to determine whether the officer's testimony with respect to the way he captured your speed is credible. However, it sounds like he may have cut you a break already? I'm not... View More

The answer is that yes, technically the officer can re-file the citation, but that has never happened in any case that I've handled.

Q: Citation Costs

I backed up into a postal service car in the court that I live in. I had only lightly tapped her front end before seeing she was there. No damage or injuries were brought to the car or driver or myself. Her work managers were called and so was 911. A state officer was the one who came to check it... View More

Fortunately no one was injured and there were no damages. Unfortunately, often times citations will be issued following a motor vehicle accident, however slight. This is a trend that has seemed to increase in recent years, at least in my experience. You should contact a local attorney for a free... View More

If your vehicle registration was expired, you should have the vehicle registration renewed and plead not guilty to the citation. On the scheduled hearing date, you or an attorney, if you hire one, can present the renewed registration to the officer and nine times out of ten, the citation will be... View More

No, a person cannot be convicted at a preliminary hearing. A preliminary hearing is not a hearing to determine guilt or innocence. It is a hearing to determine whether the commonwealth has sufficient evidence that a crime has been committed and that it is more likely than not that the charged... View More

Q: Can my ticket be thrown out for leaving the entire MARKED section blank?

I was traveling through a PA interstate (Speed limit: 70), I had my cruise control set to 80 when this ordeal happened. I have Waze opened at all times and also have a radar detector, so I knew he was there but was following the flow of traffic which I now regret. Before I pass the cop he whips his... View More

This is a situation I've come across frequently. Basically, the trooper has written you a lesser section, one that does not carry any points, either because he knows he can't prove your speed, he's being lazy, or he thinks he can prove your speed, but decided to cut you a break.... View More

Q: Speeding ticket

I was pulled over for speeding in Jersey as stated by the officer 19:9-1.2 .39 but ticketed for 3 other offenses 39:4-96, 19:9-1.3c, 39:4-88A. Two are payable the other two I have to appear in court. What would you recommend I do? Pay the two or just wait until my court date to see what happen also... View More

I'm guessing you are asking this question in this section because you hold a Pennsylvania driver's license. My understanding (and someone can correct me if I'm wrong) is that you will not receive points in PA for out of state citations, but if any of those citations you received... View More
