Paternity has been filed and I am the father

The judge looks at many factors to decide visitation. This is not something I recommend that you handle without an attorney. Your attorney will be able to look at all of the factors to help the court decide, including do you have a safe place for the child to visit; who will the child be around... View More
My boyfriend signed the birth certificate before we got married. Now we’re living separately and I’m afraid to let my son visit because he’s threatened to not give him back. What should I do ? If he doesnt give him back to me, can I call the police ?

In TN when parents are not married, the mother is the sole custodian (whether he is on the birth certificate or not) for the child unless a court has ordered otherwise. You don't have to allow him to go if you don't want to. The fact that he has threatened to not return him to you is... View More
Im 20 years old now. I made a dumb mistake when i was 16, got arrested, saw the judge, and was released on OR. I was offered a pre trial diversion in lieu of conviction as long as the terms of the diversion were met satisfactorily. I met the requirements and got the diversion successfully. I... View More

Any guilty plea as a juvenile doesn't count as a conviction. If you are asked on an employment application if you have ever been convicted of a crime, you can answer honestly no. If the application asks about juvenile offenses (which they usually don't), that is a different story. In... View More

The bondsman still did his or her job in promising the court that if you didn't show up they would pay and getting you out of jail. That is the service that you paid them for. They have nothing to do with whether your arrest was justified or not.
Right now we do week on week off joint custody. My ex husband is getting divorced again and can't find a sitter during his week so he wants them to stay with me and go to him on weekends. How can I change this so I don't have to pay him child support anymore and make it legal on paperwork?
answered on Jan 14, 2018
You can't without going to court. As far as the parenting time schedule, most parenting plans allow both parents agree to deviate from the schedule in the parenting plan. It will not change the child support though. If you want to change the schedule permanently or alter the child support,... View More

It is not illegal to video tape them at school. It might violate school privacy laws for her to post the video publicly without parental permission.
The granddaughter is trying to evict me because she just got out of jail and has nowhere to live

She cannot evict you. The grandmother can. Are you sure she doesn't have a power of attorney?
They were rewarded visitation but I am their natural father and I don't attend church? I attend the Kingdom Hall so they are being taught...

Unless the order granting them visitation specifically says that they can't take the children to church, then they can take them. If you don't want them going to church, then you should consult an attorney to see if the court will order it. I will tell you that many judges are going to... View More
Do I need those past messages to prove his infidelity? Do I have to prove his infidelity and how will that help me if I do file for divorce?
answered on Jan 13, 2018
Adultery is a ground for divorce, but it often is not as big of a deal as it sounds. Courts are used to cases involving one or both spouses cheating. If you want a divorce, you should consult an attorney . They can ask for the messages in discovery.

The only way you can stop paying child support is for your ex's spouse to adopt the child. Even if you surrender your parental rights, you will still be required to pay child support.

Do you mean she is moving? Tennessee law requires her to give you 60 days written notice before a move. Then you will have 30 days to object. The court then decides whether she can take the child. You should consult an attorney to discuss all of the facts and advise you on your legal options.

You will have to go back to court and have the judge issue another order. You should consult an attorney.
Also no DNA test on record and courts was unable to serve him with the papers to come to court. He does work and has a proper home/mailing address

It is unlikely that the court will order him to pay without proof that he is the child's father. You should consult an attorney who can help you proceed with establishing him as the father and setting child support. Since you know where he lives and where he works, a private process server... You should consult an attorney about filing a contempt petition. If he is found to be in contempt, he could face jail time. It is amazing how quickly people will pay what they owe to avoid going to jail.

If you have your parents' permission, it is not illegal, but DCS may get involved if there is not appropriate supervision of you and your boyfriend.

Unfortunately, attorneys are not allowed to solicit clients on this forum. You can search for an attorney who is experienced with child abuse and civil rights matters. How long ago was it?
I lost temp custody of my kids right now but father still on childsupport but my sister has emergency custody of the kids. Father has gotten a summons for childsupport. Why?

With the change in custody, there will be a change in child support. New calculations will need to be completed. My colleague is also right--you will also probably be required to pay child support as well.
