If there are no court orders requiring support he would have a moral obligation which is not enforceable. Consult an experienced family law attorney who will need to obtain additional information to properly assist you.

No. The stepchild is related only by your marriage and is not someone who you are legally obligated to support

Not enough information. Spousal support depends on a number of factors including the incomes of the parties. It's possible $250 per week may be too little. But without more historical information concerning your marriage and current circumstances, one is not able to answer your question.

The general principle is that you are merely a witness at this point in time. The fact that you do not want to press charges is not relevant. You have no control over the prosecution of this matter. A subpoena will be issued for your appearance at the time of hearing. Speak with somebody in your... View More

My suggestion is that you hire a probate attorney. While there might be a court ordered paternity test, was there ever an order entered stating he was the biological father? Was there a wife who survived the decedent? Was there a Will? These are the questions which must be answered and that's... View More

I was on tanf for 5 months, however I have recently closed my case as I graduated college and found a job. My case will be closed at the time the settlement conference for the child support takes place. Can I refuse the child support- as that now that I am off of aid, I really don't need it.

I would assume there is a case in which child support was ordered. Under case law, a parent cannot decline a child's right to receive support. I truly believe you would do a disservice to your child by declining child support. If you don't need the money now, you might later. Take the... View More
