To have it removed or sealed? If yes how?
answered on Feb 9, 2018
Yes, there is as long as probation was completed successfully, including payment of whatever costs were ordered. The procedure is slightly different depending on what court the case was filed in, but if it was a district or municipal court there is a pretty standard process.

The insurance company is telling me that since I had no insurance and had the car in my name 2 months prior to the accident there is nothing they can do since i had not put insurance on my vehicle before the accident. Is there anything i can do?

Yes, if the other driver was at fault then their insurance company is responsible for compensating you.
If you were hurt, and have (or need) medical appointments, you should contact a lawyer immediately so they can work with you on how to get proper treatment and get keep the bills out of... View More

In most jurisdictions, she will still be charged with DUI. Talk to a lawyer who practices DUI in your area right away to get some guidance to get through this.
I just got the car in my name and my new plates weren't on yet

Some judges will dismiss if you show the registration. I would probably call the clerk's office at the court where the ticket is filed, and ask them what is common in that particular court. If it is a court that has a prosecutor in it, you can also call their office and ask what your options... View More

If some other factors exist, it could happen. Doesn't mean the driver would be convicted at trial, certainly.
If there were other substances found in a blood draw, for example, so the .02 alcohol was not the sole basis for the charge. If the driver were under 21, then there is a crime... View More
is it legal for an officer to drive up behind behind your parked vehicle turn their lights on come in the gas station and say they are arresting you for driving without a license in washington state?
answered on Jan 2, 2018
It can be, if the officer has cause to believe she observed a crime being committed. Most often happens if the officer knows the driver and observes the driving; she can check the driver's license status from her car, and if the driver is suspended or revoked then sure, they can make that... There are different physical clues they are supposed to look for. Some will administer the 'standard' roadside tests, but since they are designed for alcohol impairment they are of limited value.
They have a number of specialized tests, called the drug recognition protocol. A... View More

Many crimes don't have a specific victim. Drug possession and DUI are quick examples.
The accident caused a traumatic brain injury, i was hospitalized for a month then for 2 weeks again a couple of months later. I was crossing the street when the driver stoped the car, there was a problem with his break so even though he stoped, it still hit me. I also still take physical therapy... View More

Sorry to hear you are dealing with that. When you are talking about a case of that magnitude, you certainly should talk to a lawyer. Most personal injury offices, mine included, offer a free consultation. You can at least have someone look at the facts of your case and the documents you have... View More

Could he be charged? Sure, it doesn't take much to get charged. There is a theory called constructive possession, that basically allows the presumption that whoever is in control of a car is responsible for whatever is in it. If the police found the car unoccupied, and he is the owner, he... View More

If you have an attorney, you really should direct your question to her or him. Different courts have different policies; generally conditions of release include no marijuana, but I would have to look at your specific court documents to be clear on that.
answered on Nov 16, 2017
No one from the court system will intentionally contact her, if that's what you mean.
If you pay the ticket (by going to the courthouse and paying in person), that's the end of the court case. It will appear on your driver's record though, so if you are on her insurance she... View More
because I'm getting confused, is it too late?
answered on Nov 10, 2017
Definitely not too late. You can get an attorney on your case at any time, although generally sooner is better before any strategy decisions are made and committed to. My office would be happy to discuss it with you, or you can search on line for personal injury attorneys.

Your roommate is fine, nothing is going to happen to him. Make sure you (both) transfer the title when the sale is done, it can be a crime if you don't. In the meantime, respond to the ticket within 14 days or it will go to collections. If you contest or mitigate it, and get a license prior to... View More

Why on earth are you doing a jury trial pro se? No, the errors on the citation aren't going to get you a dismissal. No, you do not NEED to subpoena the officer, unless you really want him to be there. I can't imagine the city can put on their case without him, so they will subpoena him.
Person was arrested yesterday and has 3 warrants for unpaid traffic tickets. Curious how long they may have to serve in jail. They also had their license suspended years ago so they were originally arrested for driving without a license.
answered on Oct 26, 2017
I would have to have some more detail. Traffic "tickets" usually means infractions, like speeding. Warrants can't be issued on those though, so I'm not sure what you mean.
Unpaid infractions result in a suspension, and driving while suspended is a crime. If that is what... View More

As far as I know, it's only a crime to DRIVE the car if the registration isn't transferred in 45 days. If you aren't driving it, no crime. No reason for the auditor's office to report you, and I can't imagine they would even if you did drive the car there.... View More

Depending on what county the incident happened in, search for terms like police misconduct, civil rights, personal injury. Find a few firms and call them to discuss the specifics of your case. Firms may not specifically advertise for this type of work, that doesn't mean they don't handle... View More

Call the court and ask them, that is probably the easiest way.
They will be sending you a summons for a court date, and that will have the case number on it if you don't mind waiting.
