There may have been something wrong with the POA, or the hospital simply refused to obey the directives of the attorney in fact. What damages did the Decedent incur because of the hospital's disobedience? There may not be any, and if so, no cause of action. If damages are present, then... View More

Q: My brother was killed and they found the other driver at fault. The driver had no DL or insur - can they go to jail

What can our family do legally? The person said they didn't see him on his loud Harley, yet hit him on the passenger front side while making a left turn. This was in Arkansas where he lived with his wife and son.

I would recommend you contact an Arkansas injury lawyer to discuss whether anything can be done in a civil claim. Regarding whether there is criminal liability for what occurred, I would need more information and also direct you to the prosecuting attorney in the County where the wreck occurred.

Unlikely as they search for drugs and if he evaded I don't see a claim. You can always check with the Ark. Civil Liberties Union prison rights section.

You have a technical defense of duress, but it's extremely difficult to prove and most juries unlikely to buy it. You need to consult an attorney who handles criminal issues.

Contact the attorney for the estate and be sure that you and your brother are listed. Ask why you were not. If you don't get a straight answer contact a member of the Ark. Assn for Justice to find one in your area--they give free consults.

If the law firm received a contingent fee, that fee would have to have been agreed by the widow and children in advance. Were they all over the age of majority when they signed the agreement? I would question the law firm's taking their fee from the $50 K settlement; they should have known... View More
