Is the mother still entitled to child support if child doesnt take fathers last name?
answered on Jun 15, 2018
Child support is payable no matter what the child's last name is. Illinois law does not require that a child bear the biological father's last name.
My son has residential custody of his son. He filed petition for mom to pay child support as outlined in their parenting agreement. She's never paid anything. She showed up at court late and wrote down a few sentences about her now wanting custody. Judge told her to give more info than 2... View More

Without knowing who the judge involved is and without having practiced before that judge, and without knowing his/her perception of the mother's past history regarding this case, there is no way to answer this other than to say the mother may or may not be given more time.
Before divorce had my adult children and grand kids living with us. Kicked my 33 yr old son out . Long story short my son and girlfriend lost custody of kids , my ex wife left and got an apartment and filed for a divorce . And finally got temporary custody of grand kids . Most likely not. There is no law to support her being entitled to more spousal support because she chooses to contribute to the expenses of someone else's children.
I'm self employed and pay her directly by check ea month. my divorce attorney says just to stop paying the month after youngest child graduates HS. no need to file with court. Ex wants support for youngest to go to college. I don't want to do this mainly because my income has drastically... View More

Were you supposed to pay directly to her.
Is that what the court order said.
My son is 15 years old and resides with his mother and his Jamaican born illegal alien stepfather.

This question does not belong in the immigration category. You should try to contact an attorney who practices family law. They will be able to give you an answer.
All the best.

Am I legally obligated to pay child support to her? Or when divorce is final will I have to pay back support? I have been paying her 650 a month because she has threatened back support.
answered on May 9, 2018
Parents in Illinois are legally obligated to support their minor children even if no divorce has been filed. Always pay child support by check. Always indicate on the check's memo line that the check represents child support.
He will not take her on weekends or agree to any weekly visitation because he wants to control me & what i do. I have tried to work with him but he will only take her when I am off work & makes me take her to him & doesn't pay for gas her supplies, food or anything. I cannot afford... View More

I do not practice law in your state, so I can't give you legal advice regarding whether you can sue.
However, in general, anyone can sue any person or any entity

You need to explain what exactly happened to figure out what needs to be done.
I have tried to be involved since i found out she was pregnant. She has avoided me and lied to me. All i am wondering is if I filled out the child support document, if i would be obligated to pay child support before we know who the father is?
answered on Apr 18, 2018
Sounds like you will be signing documents making you liable for child support.
If you are unsure, you should have DNA tests done before you acknowledge you are the father.
we pay her child support every 2 weeks and it just now went up bc he is at a highing paying job and she is asking for extra money for boots for him do we have to pay any extra

The only obligation is under the court orders.
If it just says child support, then that is the total obligation.
required to continue paying?
answered on Apr 14, 2018
If this is back child support, there must be a court order.
That court order continues.
The usual rule is that if you are behind, then when the current child support stops, withholding continues in the same amount until the arrearage is satisfied.
Even social security... View More
His mother claims I have been deemed unfit by the state of Illinois and have none. I live in Missouri and need info on finding out my rights to my son

First find out from court what orders besides child support have been entered.
If nothing, then you need to petition for modification to enter a parenting plan.
My support order has a termination date of May 27. My son is 18 and was supposed to graduate at the end of May, but since he has to make up a class, he might end up going to summer school. Worst case is that he has to go back to high school part-time for the class from Sept-Jan. Do I have to... View More

You only pay according to the court orders in effect.
Of course, the other parent could go back to court to ask for support to continue until he finishes high school or turns 19, whichever is earlier.

It doesn't matter who pays the child support.
But, it should be done properly to get credit.
Normally, it is paid through the SDU which keeps track.
His son is 17yrs need the money graduate in June/2018

It's possible his employer is withholding the support but isn't sending it in to the State Disbursement Unit, though this is not very likely. Get a lawyer (either a private attorney or through the Illinois State Attorney General's office) and take him to court for contempt. If the... View More

In Illinois the obligation to pay child support ends when the child turns 18 years old or graduates high school. If the child is 19 years and has not finished high school, the judge's usually extend child support until they graduate. This usually has to be specifically ordered by the judge.... View More
can I get child support for her
answered on Apr 7, 2018
You do not say if he is the father.
If he is, then you need to get a parentage order entered which will provide for child support, tax exemption, medical care responsibility, etc. In addition, a parenting plan will be entered.
Early 2009 I was in an intimate relationship with a woman I hardly know. She immediately got pregnant and said I was not the father.
