Q: File or not? As far as my credit score figure out how to bring things up to date and pay monthly payment

I have 50,000 in debt behind 2 almost 3 months. The best way to help my score improve. Cards are over 100% usage I am considering filing but need to know what my best route is

Q: If I don't have a ks license can I still file in ks? I have lived in Kansas for maybe 3 years.

I have all my mail come to home though. I am also being garnished and cant afford what they are taking out!!

Yes. You only need to have lived in Kansas for 180 days to file.

Q: I bought a car at a buy here pay here stopped paying due to personal reasons ita been about 8 years now and they have

You need to see if the car has a lien on it. If it does, you’ll have to pay it or bankrupt it. If not, you are free to do as you wish.

Q: I have court today for aid in execution. Would it be best to file bankruptcy? Will it stop this?

A bankruptcy filing would stop the need for a hearing in aid of execution. The bankruptcy attorney would be able to notify the other side of the filing, and keep any further action from occurring whether that be garnishment, attachment, etc.

A 401(k) and a 401(k) loan are really not affected by a ch 7 bankruptcy. The funds are exempt and not subject to being lost to the bankruptcy court, and the loan is secured and not really affected by the bankruptcy either, as any failure to pay would still allow the retirement funds to be offset... I don't want my daughter to know that I'm filing bankruptcy. She pays the loan herself, but do I have to include that loan in my filing since it can't be discharged?

No. You must include all of your debts as well as giving notice to your daughter as a codebtor.

Q: Can I keep my house and a small building I purchased for my girlfriend If I file bankruptcy?

Assuming your source of funds to purchase these items did not consist of hidden funds that existed at the time of the bankruptcy filing, you should be fine. Purchasing assets after discharge but before the formal closing of the case, is not a problem, just so long as there weren't any assets... View More
