Q: I would like to know if the case against me in Lexington,Ky. between 2000=2003 is a misdemeanor or felony?

I went and finished anger management classes and alcohol addiction classes as ordered by the judge. Q: I have a DVO against my ex-fiance. Can he be made to leave a building if I get there after him? I am in KY.

It is a public gym that we both go to. I look for his car before I pull in to ensure that I do not give him a reason to cause a scene, but I am worried I might miss it. He was abusive, and I am worried for my safety.

Generally, law enforcement makes the decision and the abuser is arrested. You may want to get some investigative reporters and make this known. Q: With a dvo warrant will you get arrested if i was tryubg to get it redocketed?

I have a dvo and I went to court and the judge gave me a code to go put back in to come back after lunch but it didn't w work and now I have a warrant and now I would like to go back up there to redocket it so I don't have one but will I get arrested when I go up there to try to redock it

You could be arrested, yes.You should probably hire a lawyer to get the warrant set aside and get a new date for you.

Q: Does the “no contact” rule on a DVO only apply to the abuser (the person who committed the abuse)? I’m in KY

DVO issued, he was charged and is sentenced to 2 years in prison.

Typically, in a domestic violence order, the abuser can have no contact with multiple people, including significant others and children. People who are victims or not under a no contact order. You can’t amend the epo prior to the hearing. Go on your hearing date and explain the logistics to the judge. She can set all the arrangements and see that you have some place to reside.

Q: DVO motion

Can someone that’s absolutely not involved in a DVO case write a letter to the judge about our case? I’m the petitioner. Like my exes mother of his children is trying to write a statement and his mother hates me and is trying to do the same. Is that even legal?

I do not practice law in Kentucky. Generally, courts do not accept letters from people purporting to be witnesses. It means a person who brings a dv claim cannot be held in contempt for later failing to appear in court and prosecute that claim.

You cannot post a bond without saving to pay unless it is an unsecured bond.

You are violating the DVO by returning home before it is amended. If anyone reports it or if the police are called and find you there, you will likely be arrested and charged with violating the dvo. You should go somewhere else to stay, hire a lawyer to get the dvo amended, and not have any... View More

If you are the one with the EPO charges against you, you are not allowed to have any contact with her. If you have contact you could be charged with violating an EPO and be arrested on a new criminal charge. She is not under any restrictions. She does not have an EPO against her from what you are... That still can be domestic violence. Usually, the court will consider the petitioners request.
