Can someone that’s absolutely not involved in a DVO case write a letter to the judge about our case? I’m the petitioner. Like my exes mother of his children is trying to write a statement and his mother hates me and is trying to do the same. Is that even legal?

I do not practice law in Kentucky. Generally, courts do not accept letters from people purporting to be witnesses. The only way to present evidence to a court is either as an exhibit attached to a motion or to properly introduce it at a hearing or trial, in accordance with your state's Rules... View More
What does this mean exactly? Can I as the victim get in trouble for not showing up to a court date? I just put in a motion for a violation. What happens if I do not go?

It means a person who brings a dv claim cannot be held in contempt for later failing to appear in court and prosecute that claim.
If you were arrested in 2020 and signed an plea to be release, if possible can the charges be dismissed

Highly unlikely. Much better bet to expunge it after 5 years.

You cannot post a bond without saving to pay unless it is an unsecured bond.
Wife filed a DVO four months ago.
And decided to tell me she wants me back home and doesn’t want to divorce. We have a newborn together as well. She brought me home recently in the hopes it would be amended.
Turns out judge said no.
Can there ever be a random search for... View More

You are violating the DVO by returning home before it is amended. If anyone reports it or if the police are called and find you there, you will likely be arrested and charged with violating the dvo. You should go somewhere else to stay, hire a lawyer to get the dvo amended, and not have any... View More
1 officer let himself into my home through 2 doors & a flight of stairs! I had called 911 & hung up to scare my husband.
The cop opened my front door & chased my husband down. I stood there in shock. A few minutes later, another officer arrived & told me to put my dog up so... View More

No. Whether to prosecute or dismiss the charges is solely up to the prosecutor.
Will this help me in my DVO case?

If you are the one with the EPO charges against you, you are not allowed to have any contact with her. If you have contact you could be charged with violating an EPO and be arrested on a new criminal charge. She is not under any restrictions. She does not have an EPO against her from what you are... It was verbal threats only, and smashing an Apple Watch.

That still can be domestic violence. Usually, the court will consider the petitioners request.
What can I do to get this dismissed? She states it's because I have key to our apartment (no guns or really anything inside, my stuff was emptied out of it). When the attempt happened, her family took my key and never gave it back. The leasing office gave me the key back since I paid rent and... View More

Should be able to, yes, unless you’ve been convicted of other crimes in the interim.
Wife filed EPO, while I was at work. Spoke of past rage issues of mine where authorities were called and she left to take a breather and come back. Still no charges. She contacted me while I was in the hospital over the last week. But said I could not call back. Refered to me as her husband still.... View More

Victim was the one that police came in on and because the detective didn’t get what me wanted from me he turned to my boyfriend and had him arrest 3 months after the fact. An arrest can be made by police in a domestic case based on probable cause determined by the officer. He does not have to witness it or be present. An arrest may also be made upon a warrant issued upon a sworn statement of the police or private citizen. Consult a criminal defense lawyer near you... View More
While in court I understand the two parties will use evidence against each other, what should the victim look out for? How could the abuser turn the story?
answered on Dec 5, 2022
The abuser can attempt to file charges but typically the charges are not accepted by the County Attorney if they are the second one to file.
