Q: DVO motion

Can someone that’s absolutely not involved in a DVO case write a letter to the judge about our case? I’m the petitioner. Like my exes mother of his children is trying to write a statement and his mother hates me and is trying to do the same. Is that even legal?

I do not practice law in Kentucky. Generally, courts do not accept letters from people purporting to be witnesses. Q: C. No petitioner may be held in contempt for failure to appear at a domestic violence hearing or to prosecute a criminal

What does this mean exactly? Can I as the victim get in trouble for not showing up to a court date? I just put in a motion for a violation. What happens if I do not go?

It means a person who brings a dv claim cannot be held in contempt for later failing to appear in court and prosecute that claim.

Q: Can a DVO charge be dismissed?

If you were arrested in 2020 and signed an plea to be release, if possible can the charges be dismissed

Q: How can you post a bond for an inmate without having to pay there no percentage taken off and wonder a way around it

My boyfriend is in jail for domestic violence we go on the 7th for an epo that I will be dropping ur has other charges that can up during the violence and past felony convictions

You cannot post a bond without saving to pay unless it is an unsecured bond.

Q: What happens if my wife brings me home before the judge has ruled on a DVO amendment? Can there be a search warrant?

Wife filed a DVO four months ago.

You are violating the DVO by returning home before it is amended. If anyone reports it or if the police are called and find you there, you will likely be arrested and charged with violating the dvo. You should go somewhere else to stay, hire a lawyer to get the dvo amended, and not have any... View More

If you are the one with the EPO charges against you, you are not allowed to have any contact with her. If you have contact you could be charged with violating an EPO and be arrested on a new criminal charge. She is not under any restrictions. She does not have an EPO against her from what you are... Q: When will a judge not drop an EPO at petitioners request? It was not physical and both parties were intoxicated.

That still can be domestic violence. Usually, the court will consider the petitioners request.

An arrest can be made by police in a domestic case based on probable cause determined by the officer. He does not have to witness it or be present. Q: Can the abuser also file a domestic against the victim?

While in court I understand the two parties will use evidence against each other, what should the victim look out for? How could the abuser turn the story?

The abuser can attempt to file charges but typically the charges are not accepted by the County Attorney if they are the second one to file.
