Q: Does New Jersey have a fix-it clause a police officer can use for minor violations?

My son received a loan for his car. I originally bought the vehicle and had the loan in my name. He registered his car with the DMV. He received his new plates, registration, and had current insurance through USAA. He forgot to change his plates. A few days later he was pulled over.... View More

Unfortunately no excuse exists for having ficticious plates on your car just like sorry officer I didn't see the speed limit sign doesn't work either when going 100 mph. Depending on the charges I would suggest that you hire a lawyer.

Q: What happens if I decide not to pay my parking ticket?

That depends on what the judge wants to do. A warrant for your arrest could issue and your drivers license could be suspended as stated on most tickets. Thus don't take a chance and pay it.

Q: What's the chance I'll go to jail if I am charged with 2C : 18-2A (1) and 2C : 17-3A (1)

I was in a abandoned building but I wasn't doing anything. My friend was damaging the place and my other friend was telling him to stop.

Everything depends on what you did and your prior criminal record. First time offender programs exist which can definitely help you avoid jail, BUT the prosecutor can deny entry in to them and Burglary one of the crimes you are charged with is a common crime to be denied entry into PTI for. Q: How is jurisdiction established when it's questioned? Can I be forced into a contract of another's making?

I was told that, unbeknownst to me, by obtaining a driver's license I subjected myself to the jurisdiction of a woman sitting as a judge in a Municipal court.

I believe she's lying.

Definitely hire a lawyer for him he is looking at losing his license and points. Although a 17 year old can't get a no point ticket a lawyer can still help.

answered on Nov 14, 2018

The options are always the same:

1) go to court and plead guilty

2) go to court yourself and probably be found guilty

3) hire a lawyer to go with your son in court and hope that one or more of the tickets can get dismissed. Even for a lawyer having a probationary drivers is...

Q: I got a ticket for unsafe driving, first offense, and received points on my license...is that correct?

I drove on the side of traffic, as if I were going to make a right turn, and a police officer saw me and gave me a ticket for unsafe driving. But I just read that for first offense for unsafe driving in NJ, there is no points for first offense only third offense are subject to points. Am I correct?

1) Don't believe anything you read online, unless you also read the disclaimer on the website.

2) It generally does not have points but certain class of drivers may get points such as a person who is 16 or 17 they are not allowed to get a no point ticket so it could carry points for...

Best way is to hire a good lawyer. Second best way is to understand that you do not need to be stopped by a police officer to get a ticket and understand that it is generally mailed regular mail to your address on file with MVC. If they had your wrong address which is generally the case why... View More

Q: My 17 year old daughter received a ticket from NJ violation 39:4-97.3 - she is a probationary license

We can prove through Life360 app which monitors phone activity while in motion and Verizon that she was not using her phone while in motion. She was at a red light. Two questions, will the judge accept this and shouldn't the citation be 39:3-13.4 as she is a probationary license holder until 18?

H. Scott Aalsberg
H. Scott Aalsberg
answered on Nov 6, 2018

Its the correct citation and remember its not whether you were using the phone its whether she was holding the phone which is the violation. If it is a first offense you may consider paying it as hiring a lawyer for these types of ticket is expensive.
