"Pain and suffering" refers to conscious physical pain and suffering as a result of bodily injury. From the facts you describe, it appears unclear as to what bodily injury, if any, you sustained. You may be able to sue for a civil rights violation, but it doesn't look to me like... View More

You cannot remove a citation from your driving record once you have been found guilty and the Court has entered a final judgment. You have to take the steps necessary to avoid the final conviction. Call an attorney BEFORE you do anything with a court. Good luck

Q: Can I receive a fictitious registration ticket and a expired registration ticket by the same cop?

I got two tickets by the same cop, he wrote a ticket for displaying a “fictitious” registration, but also gave me a ticket for the “fictitious” registration being expired. I no longer own that car, but I thought cops couldn’t give you two different tickets for one thing?

Once warrants are issued, they don't disappear. You either have to post bonds or get arrested. Calling an attorney in the county where the warrants are pending would help. Good luck.

Yes. A traffic ticket is just a citation to appear. Tickets are issued all the time based on alleged criminal activity reported to police by ordinary citizens.

But your friend can ask for a trial. Because the cop didn’t actually see the offense, the person who reported it will need to...

Short answer, yes, your car can be towed even if it is in a private parking lot. Hypothetical: if someone parked their car in the private driveway of your home and left it there, do you feel you could have the car towed?

Q: if i buy a car today under my name, will my current warrant show up when a cop looks up my plate number?
John Michael Frick

answered on Oct 20, 2022

It is highly unlikely.

The paper plates a dealer puts on a new or used car when it is purchased are tied to the dealer, not to the buyer.

Until your permanent metal plates arrive, the plate number won’t be tied to you.

The citation (ticket) is merely notice of when and where to appear in court. The questions is whether there are any defects in the charging instrument (the complaint) and whether those defects are material.

Q: Can I get a ticket dismissed if the officer knowingly lied about posted speed limit on my ticket?

I was in a 70mph zone, clocked in a 70mph zone and stopped just before the 65mph sign but he wrote me a ticket as if I was in the 65mph zone. He falsified a document.

The first question is what is the alleged location in question. Next, the zoning of that location must be checked. Whether the officer lied or not is a question of fact which is what trials are for; the officer has the right to appear in court to testify just like you do and she/he may claim YOU... View More

CAVEAT: I DO NOT REPRESENT CLIENTS IN TRAFFIC TICKET CASES, but

Driving over the speed limit is a crime, whether it's one mile over or ten. Many cities have "tiered" speed limit fines. In Houston, your fine would be $195 for going 10-14 mph over the speed limit, but only...

Q: Does a ticket get dismissed if the officer doesn't show up?

I was in an accident and received a ticket for running the red light. I told the officer (truthfully) that there was a tree covering the stoplight and I couldn’t see it from the road. He said to go to court and tell the judge that, and it might be dismissed.
