There may be several options available to you such as amending the charge to a different charge. However, you should hire a lawyer in Virginia, as the speed you were charged at is a criminal offense in Virginia. Call a lawyer soon.

Q: Do you have to stop for a bus on a divided highway that had a break for an intersection in Virginia?

answered on Jan 3, 2018

I think it depends on the size of the break, and what type of intersection - major crossing street, or simple turnoff into a neighborhood. If you've been charged under these circumstances, it would be worth consulting with a traffic attorney in your area to look a little closer at the law as... View More

Q: Sentenced to driving school in va for #2 ticket, had #1 in TN. Got #3 after court sen. and before class. Can still take?

The 1st ticket in Tn was a failure to obey road sign. #2 was a reckless driving ticket in VA because my wheel axel snapped while turning sharp and lost control and crashed the car. This is when I was sentenced to driving school. #3 was a red light in VA that i got after I was sentenced to driving... View More

You can probably still take the class, but one of the requirements to having the court reduce/dismiss the charge is that you obtain no new tickets for a certain amount of time after you are sent to driving school. Call or meet with a traffic attorney, if you don't already have one, to review... View More

Q: I received a ticket for reckless driving 46.2-862. Going 67 in a 40. What can I do?

Should I hire a lawyer? My court date is in February. The officer said that if I attend a defensive driving course that I could have the charge reduced or dismissed. How likely is it to be dismissed completely?

Q: Caught speeding in Virginia, got a reckless driving charge...should I worry about jail time?

So, on Christmas Eve, I was caught speeding. He said I was going 81 in a 45, but I THOUGHT I was going 70 TOPS in a 55. That doesn't make it right, but I genuinely had no idea I was going that fast or that the limit was so low.

He wrote me a ticket for reckless driving. It was on the... View More

Jail is very unlikely. However, if the reckless driving charge (a criminal misdemeanor) is not reduced to a traffic infraction, it could cost you major dollars in an insurance increase for the next 3 to 5 years. You should also check with the NC DMV to learn what they will may do if you are so... View More

Yes, a good traffic lawyer may be able to get the case deferred for dismissal with completion of a driver improvement course. Or possibly reduced to a non-moving violation like Defective Equipment that carries no points. This would save you six demerit points on your driving record and insurance... View More

Yes, hire a lawyer to go to court and get it dismissed or reduced to a traffic infraction. You have a great record, and it is unlikely you will lose your license or go to jail. Contact the clerk of court and request to file a Motion to Reopen the case. Explain to the judge at the hearing what happened, and show him your proof. The judge will more than likely vacate the judgment and set a new trial date at the officer's next court date.

If the charge was dismissed, it should not appear on your record. The best thing to do would be to have the charge completely expunged from your record so that your record doesn't even show that you were charged with reckless driving.
