Q: can I use documentation from another source that proves he is violent, threatening. I have a DV case against him

I have paperwork from his employer that has dates when he threatened or harassed other employees (men and women) He was put on Administrative leave for all this. He was going to get fired but Retired instead. I need all the proof I can get regarding his behavior.

this is a question you should present to your lawyer that is assisting you with the TRO????

you usually need more than documentation. You would need someone or some people to come to court to testify.

You have aright to notice of a hearing on a restraining order. If you don't want the restraining order, then contest it. By the way, doing this on your own is a bad idea. Get a lawyer. Good Luck

Sort of. With the facts you describe, the criminal judge will likely grant the DA’s request for a CPO. You can reach out to your DA victim advocate to make sure they ask for this at the arraignment.

however, if there is a complaint already, then it is on your record.

at some point, you can possibly make a motion under 1203 to withdraw the guilty plea to this...for instance and enter not guilty, and then the court dismisses it.

if you can hire a local lawyer. s/he should argue the ex is on probation and his actions violate probation and ask they he be violated....maybe request probation violation hearing
