local PD signed ticket ,but I didn't.

answered on Dec 21, 2023
If you received a traffic citation in Georgia and did not sign it, but the local police department signed the ticket, it is generally not a critical issue. In many cases, your signature is not a mandatory requirement for the citation to be valid. The officer's signature is usually sufficient... View More

In Georgia, if you received a citation for non-working brake or tail lights but believe this was incorrect because your lights were functioning, this could potentially be a basis to challenge the traffic stop. However, the subsequent discovery of schedule 2 pills during the search adds complexity... View More
The officer threatened me with jail to sign my name as it appears on my state driver's license during a traffic citation and not to write no contract on the citation.

Most traffic violations in Georgia are misdemeanors (that is, punishable by a fine of up to $1,000 and up to 12 months in custody).
OCGA § 40-13-2.1 is the relevant statute:
"(a) A person who is issued a citation as provided in this chapter or Code Section 17-6-11, relating... View More

The amount of time that law enforcement agencies have to charge someone with drug possession from a traffic stop varies depending on the jurisdiction. In some jurisdictions, the statute of limitations for drug possession cases is one year, while in other jurisdictions, it may be two years or even... View More
I was involved in a car accident yesterday in which I hit someone. At the scene, my insurance appeared valid, but later I found out it had lapsed. Law enforcement issued me a ticket. Given this situation, is there a possibility that I could face jail time?

answered on Mar 23, 2025
It's technically a possibility, but practically- I know of no jurisdiction that actually recommends jail time for a first offense of on this charge.
I received a traffic ticket from an officer in Georgia for having no brake lights, but the ticket was not signed by me as the defendant. Does the absence of my signature on the ticket void it, or can it still be enforced?

answered on Mar 14, 2025
A ticket can still be prosecuted even without your signature.
I was involved in a hit and run on February 13, 2024, on Emery Highway. I have received a traffic citation related to this incident, and I have spoken with the Bibb County Sheriff's Office to share my side of the story. What should my next steps be regarding the citation and the hit and run charge?

A Georgia attorney could advise best, but your question remains open for three weeks. Until you're able to consult with a Georgia attorney, your priority would be to consult with an attorney to discuss any citations or charges. The next thing to think about would be placing your insurance... View More
My car passed through a school zone when the lights weren’t flashing at an acceptable road speed, but I was cited by an automatic speed detection device. A Georgia traffic defense attorney could advise best, but your question remains open for a month. In many places, those zones have gone into 24/7 operation. It's possible that's the case - check with a local traffic ticket defense attorney or the entity that oversees enforcement for... View More
In Hall County, GA, do police officers need a permit to independently monitor traffic speed on a public road while stationed in a privately owned church parking lot, where 'no loitering' signs are posted and without prior permission from the church?

answered on Feb 20, 2025
Perhaps? But either way, I do not think that would be relevant to the elements of a speeding offense and would not invalidate the ticket.
A person was stopped because the automatic plate reader indicated the owner of the vehicle the person was operating had a possible warrant. The driver was not the owner and didn't match the description of the owner. The reason for the stop, according to the report, was due to the data solely.... View More

answered on Jan 24, 2025
In this situation, the legality of the traffic stop hinges on whether the data from the automatic plate reader (indicating a possible warrant for the registered owner) provided enough reasonable suspicion to justify the stop. Courts often consider whether the officer had specific, articulable facts... View More
I am an RN and i got pulled over after work due to “expired tags”. I was on a dark road during being pulled over so I waited while driving slowly to the nearest gas station. I’ve never been pulled over before so i was scared and didn’t know to put on my hazards. my tags were never expired,... View More

answered on Dec 27, 2024
There is a lot that can be done in a situation like this. First, if the tag office has conceded that your registration was valid then the prosecutor should work with us to drop that charge. Next, I have dealt with several cases that involved my client delaying there stop so as to find a safe and... View More
I live in Georgia and was ticketed in the City of Atlanta for violating ocga 40-6-44. However, I was not attempting to pass or overtake anyone. It sounds like you have a valid argument against this charge. To give you an informed response, a lawyer would need to review the dashcam video and better understand the context of the situation. We would be able to get the dashcam through discovery and fight to have the charge dropped.
I have never been stopped I hardly drive and honestly i was not financial stable to get car insurance for my car. Car now has car insurance btw.

You should look for a lawyer to help you negotiate with the prosecutor. If you have insurance now, you can likely avoid both jail and a license suspension.
I was working for a person can the charge stick

answered on Dec 9, 2024
Not sure about your question. If you are asking if the fact that you were working for someone else when you were driving on a suspended license is a defense, the answer would be no. However, if you have a separate question please feel free to reach out to clarify.
APD Officer told me the ticket is No points and I can pay the fine online. Is this true?

answered on Nov 12, 2024
No, that is not correct. That ticket is a 3-point violation. Also, if the ticket was issued as the result of an accident, even if you are be able to pay it online, Georgia law still requires you to show up for your court date.
Now they issued a failure to appear warrant. I thought at worst that I would forefit my cash bond to settle the case and it would just end it as an admission of wrong doing

answered on Oct 28, 2024
Hire a GA attorney now to turn you in off the Docket, then start representing you. Also find out what you need to reinstate the DL.
They’re wanting me to schedule a court date or come pay the fine. The cop that issued the ticket doesn’t even work at the police station anymore. Is there a way to get out of this is there a statue of limitations or something?

answered on Oct 24, 2024
You should definitely try to schedule a court date and try to resolve it. With a ticket that old, there's a good chance that they will just dismiss it once it makes it back in the courtroom and prosecutor has a chance to look at it. That won't ever happen, however if you don't show... View More

You might have been cited for no working turn signals if the officer couldn't see them in action or if there was a malfunction they observed. Even if your turn signals are working now, there could have been an issue at the time of the stop that the officer noticed. Additionally, having one... View More

You could move for a "motion to dismiss for want of prosecution," and you can make the motion orally if you're in court and the officer does not appear.
