The fact that you hit the vehicle in front will generally generate a following too close charge regardless of the circumstance. However, this does not mean it is what you need to plead guilty to.

From my experience, your best success will come from hiring a local attorney that handles...

Q: What are my chances of successfully having a citation for violating ocga 40-6-44 thrown out?

I live in Georgia and was ticketed in the City of Atlanta for violating ocga 40-6-44. However, I was not attempting to pass or overtake anyone. I was simply making a left hand turn, and there were no oncoming cars within several hundred feet. The officer simply told me that I didn't wait my... View More

It sounds like you have a valid argument against this charge. To give you an informed response, a lawyer would need to review the dashcam video and better understand the context of the situation. We would be able to get the dashcam through discovery and fight to have the charge dropped.

You should look for a lawyer to help you negotiate with the prosecutor. If you have insurance now, you can likely avoid both jail and a license suspension.

Not sure about your question. If you are asking if the fact that you were working for someone else when you were driving on a suspended license is a defense, the answer would be no. However, if you have a separate question please feel free to reach out to clarify.

No, that is not correct. That ticket is a 3-point violation. Also, if the ticket was issued as the result of an accident, even if you are be able to pay it online, Georgia law still requires you to show up for your court date.

They’re wanting me to schedule a court date or come pay the fine. The cop that issued the ticket doesn’t even work at the police station anymore. Is there a way to get out of this is there a statue of limitations or something?

You should definitely try to schedule a court date and try to resolve it. With a ticket that old, there's a good chance that they will just dismiss it once it makes it back in the courtroom and prosecutor has a chance to look at it. That won't ever happen, however if you don't show... View More

You might have been cited for no working turn signals if the officer couldn't see them in action or if there was a malfunction they observed. Even if your turn signals are working now, there could have been an issue at the time of the stop that the officer noticed. Additionally, having one... View More

I'll answer the question by saying it's not a "fatal defect" that would cause the ticket to be dismissed. For example, a prosecutor can fix such a problem very quickly by simply filing their own accusation in court, which of course would be signed and valid.
