Q: if im traveling in my vehicle for personal use, do i need to have a license, insurance, and registration/license plate?

there are various supreme court rulings stating that operating a motor vehicle in your personal capacity is a right, not a privilege, and you dont need a license, insurance, or registration/plate so long as youre not using your vehicle for commercial use such as uber, or delivering goods.

You'd need the license, insurance, registration, and license plate - both fed and state governments have rights to regulate use of vehicles. Driving is considered more a privilege than an inalienable right. The fact that the use is personal rather than commercial doesn't lessen state... View More

Yes, you have no right to privacy over your license plate. It's observable to the public so you have no expectation of privacy. Furthermore, some police now have technology in their vehicles that automatically scans all the license plates around the police car, runs them, and then alerts the... View More

The ticket is not technically a "super speeder," but at 17 years old, there can be serious consequences for a speeding violation of 35 miles over the limit. The specifics will depend on what particular court your case is in; I would recommend that you speak to an attorney who has the... View More

While pulling a UHaul truck into a car wash, I barely made contact with an overhead PVC pipe on a chain that displayed the height 8' 6". It fell to the ground and broke. It was after hours and didn't have pen and paper to leave a note or an after hours number. I knew the car wash... View More

I am sorry to hear about your situation.

In terms of your charges, O.C.G.A. § 40-6-272 refers to your duty to contact the owner of the car wash after striking the PVC pipe (i.e., a fixture). I am not aware of what statute would apply to a hit and run in your situation. Georgia does...

This is a fact driven scenario and will be determined based on the evidence that can be produced. If you were able to signal the lane change after stalling, it is possible the party who rear-ended you would be at fault for following too closely and would be liable for your injuries. However, if the... View More

I know Tift County State Court very well.

The local court fine for Tift State Court is set according to the court's own fine schedule. You can check with the Clerk's office to determine the local court fine amount for this speed if you were to just plead guilty to the ticket...

Most speeding fines are imposed according to a schedule, but the amount varies from jurisdiction to jurisdiction. If you want to know ahead of court, you can call the clerk and ask them the fine amount.

Your speed does indeed qualify this as a "super speeder" ticket. That...

Q: A school zone has a posted 35 mph speed sign "when flashing". When not flashing, the posted speed limit is 45 mph.

Around 1pm, I was traveling at 46 mph through the school zone on 130 Killian Hill Rd NB, Lilburn Ga. School was in session that day. However, the 35 mph speed sign was not flashing. Should I have been ticketed by the red camera for going over 11+ mph of the posted speed limit?

School zones are usually designated with signs in addition to a flashing light. As long as the school zone is properly marked and designated, and it's within the posted times for the zone to be active, I don't think it matters whether the light is flashing or not.

A Georgia attorney could advise best, but your question remains open for a week. It could depend on the nature of the signs and extent of obstruction of visibility they created, and who exercised control over the site. Additional details would be useful to enable a more detailed analysis. Good luck

Pay the fine. However, if you pay the fine, you will be admitted to the offense and the ticket will be added to your driving record. This could result in higher insurance rates or even a suspended license if you accumulate too many points.
