He can go to probate court and establish a guardianship for them with you as the guardians.

Q: I adopted a puppy from a shelter on Saturday today the shelter calls me and tells me the owner wants it back

Turns out the shelter violated the mandatory hold law and let me adopt the stray puppy aftr 3 days at the shelter. I dont want to give it back he is part of the family now and my son adores him and calls him buddy. What do i legally have to do

You can keep the puppy or you can give the puppy back. You are fine either way. The shelter is the one with the problem if they adopted him out too soon. Best course would be to file a custody sction against them and then everyone enter an agreed order awarding you custody.

If they have been adopted, you are pretty much out of luck. If they have not been adopted, you need to hire an attorney and have him revie and file a motion immediately.

If there are no provisions for visitation in the case where you signed over custody, you will need to make a motion for a parenting schedule to be set in that case.

Q: My father had gaurdian ship of my children he passed away .Can i go pick up my son

My step father had custody through the court but he passed away two days later i go to check on my son and some guy i dont even know told me he has custody and to leave but i have seen no court papers or proof .how could i look this information up also check on a court date in the future

Wait til you turn 18 and do it as an adult adoption. Then your mother can’t stop you.

You should hire a local lawyer to go in and ask the court to set aside the adoption. After it becomes final it may be too late.

It will vary widely from court to court, but generally speaking, he should be able to adopt her.

Legally, yes, although genetically it may not be a good idea if the cousin is first or second. Beyond that degree, you are probably ok.

Unfortunately, yes. While four weeks is far too early to separate from the mother, there is no law that prohibits it.

You could file a motion in the CPS case to possibly be awarded temporary custody by the court. Since you have never had possession or provided for this child, you do not have standing to file for custody as a “de facto” custodian. Your only shot is with the court in the dependency action.

Contact a local family law attorney who specializes in adoptions. If your ex is willing to sign to terminate, it should be a relatively simple process.

Q: is it possible to get emancipated at age 16 with parental consent? If so, what do i need in order to do so?

You will have to petition the district court in the county you live in to emancipate you. It is up to the district judge but if your mother consents and the judge believes it is appropriate, it could be granted.
