Q: My bedroom is in an unfinished basement and I am sick with mold toxicity. What can I do to leave the lease and house?

Establish that there is mold in the house and that is the cause of your sickness. Put them on notice of it by sending a letter and demanding it be corrected. If not corrected, you can void the lease and move.

Q: lived in unit for 10 months and owner has never sent bill for utilities. Lease say renters pay utilities.

You don’t have to pay them unless a demand for payment is made to you.

Q: Injust signed my lease one month ago, I found cockroaches in my home and they treated them twice. Can I break the lease?

I called them three times without a answer.

If the treatments resolved the issue you cannot break the lease. If you still have cockroaches after two treatments and now they won’t respond, you should give them written notice of termination as you move out.

Q: If me and a lady made a deal if she got a car in her name I paid payment can I sue her for my lost money in the car

Me and a lady was dating my credit was not too good I needed a car so she put it in her name and I have been in poession of the car for over a year as well as made al payments and repairs and upgrades so can I sue her to get my money back since she took the car from me

Yes. You can sue her to determine her rights, your rights, who gets the car and eho pays what.

First, this is not a class action lawsuit. Class actions are for multiple Plaintiff who have been harmed the way you have. Second, they are only entitled to a peaceful repo without breach of the peace. If you had not given them the key, they would not have been able to repo the car at all.... View More

The fact that it is not notarized or has missing information is of no import. Incorrect info maybe/maybe not. Where you may win is fraud. You may have to file suit to do it, but if he made fraudulent misrepresentations about his boat, you should prevail.

Q: Hello, im a photographer and i agreed to do a wedding,

i received a deposit for this event and my website states that refunds are nonrefundable. we had a mix up on the date and i was unable to do it, being im a state away from the event. she wants to sue me for fraud over the deposit. do i legally have to refund it to her ?

You defaulted on the contract and you do not want to return the deposit?

You were a state away from event and willing to travel there to do the job and now want to use it as a defense from suit.

She likely can sue you in that state or your state.

Print out all your proof and let a local attorney review it. You may have to sue them for breach of contract to collect.

Q: How does my children go about getting POA of their dad, which is an incompetent drug addict?

They are constantly being notified from health and law enforcement officials of finding in ditches or overdosing. The children have tried numerous times to help. But he refuses to seek help

If he is truly incompetent, he can’t give them a POA. If he is lucid and aware, he. Oils simply sign a POA before a notary for them.

Q: my wife and I had an agreement with a lady to live in and work on a house, rent free. She evicted us, and is now suing.

The 'rent', was agreed to be in the form of our labor in working on the house, as well as paying for some materials. She has since served us with an eviction notice. This was a verbal only contract. The lady that evicted us has decided to sue us for $2500.00. What can we do?

Hire a local civil lawyer ho handles civil litigation. Generally, agreements involving real estate are enforceable only if in writing. So, you may not be able to collect for your work but conversely, she likely can not recover her”rent” if everything was verbal.

You need to foreclose, terminate land contract and evict all in the same action. Contact a local attorney near you who can devise you as to all your options.

I don’t believe there are any statues regulating the age at which a dog can be first sold, but health and safety concerns generally dictate they be at least 8 weeks old and some breeders wait up to 12 weeks before seeking them.

Q: My girlfriend & I purchased a AKC registered English Mastiff from a breeder.

We did not sign a contract at the time of purchase... 7 months later the breeder sends a contract through the mail to us & is demanding we sign. Do we have to sign? & the breeder has already signed & back dated before the actually date of pick up.

Q: A lady purchased a home from my wife and I on a land contract in AL. The home was recently damaged by sewage backup.

We received an insurance check from her insurance company to sign. How can we be sure if the insurance money is used to repair the house?

Q: My electric has been turned off & and my lease ends 12/31. can the landlord charge me for the bill coming in their name?

They charged me for the cost of the electric bill plus an additional $65 dollar late fee. Technically, that fee is in the lease agreement but only for late rent. My rent was paid in full on time for the month.

If it is in the agreement for utilities or another provision related to the electric bill, they can charge you. If it is not in the contract, it is not enforceable.
