Q: Why am I being refused a drivers license in Kentucky when I provided them with SS card and prior driver license from TX?

You should consult a competent traffic attorney to handle this for you bc it is an administrative nightmare.

Q: Custody during divorce

Just recently filed for divorce husband will be served papers this week. Child is currently living with me and has been for months. Do I have to let him see her or take her?

Not until there is a parenting time agreement agreed upon or ordered by the court.

Q: got a workmans comp settlement for future benefits till i am 70 years old is my wife entitled to any and how much

i got in an accident in october of 2016 finally had a settlement in december of 2019 for my disablity till i am 70 my wife left in october of 2019

If you’re still married, she’s may be entitled to whatever you earn until you are divorced. Hire a divorce attorney immediately.

If you were married in 2016, she’s entitled to half.

If the child is under 4 years, you can get back support. If the child is over 4 years, you can only get back support from the time you file the petition and motion for support going forward.

Absolutely you can fight. If it was acquired during the marriage, it is half yours regardless of who’s name it is in.

No. Non-custodial parent has no legal obligation beyond what is ordered by the Court.

There are many lawyers who will do a divorce for a flat fee if it is all agreed on. Call around your county and see who might be willing to handle it for you.

Q: What can I do if my spouse won’t sign the uncontested papers, so I can file them?

You can file for divorce and she will have 20 days to file an answer. You may want to consult with legal counsel. If she refuses to co-operate you can still get divorced. You will have to properly serve her with the petition and a summons.

Q: Am asking for transfer of ownership of vehicle in divorce.

I am asking for title/ownership transfer in divorce. Right now am waiting for court approval to waive filing fee before process of divorce begins. I do not have in possession the title, only the vehicle. Is my husband able to legally sell this car before divorce is processed and/or finalized?

Depends on whether the Court in your county enters a status quo order. I’d keep the vehicle in the garage or locked up when not in use until there’s is a resolution just to be safe.

The car is marital property regardless of whose name it is in. Father does not have standing to take a warrant against you. Keep the car, cut off all contact and proceed with divorce.

Yes. Three options: 1). You buy him out and keep house. 2). He buys you out and he keeps house. 3). You all see the house and split the profit/loss.

Most courts won’t let him terminate his rights unless there is someone to adopt him. You can pursue visitation and child support or forego it, whichever you choose. You are in complete control.
