Q: I am a custodial parent, but I shared custody with noncustodial. I have to pay noncustodial parent support. Why is that?

Custody where I'm domicile and primary caretaker, and it's 50/50.

Q: In the state of Louisiana what is the maximum they can garnish my SSI benefits for child support arrears

I am $16,800 in arrears on my child support but last year was found to be disabled and now receive Supplemental Social security benefits and it's my only source of income. How much if any can be garnished for my child support obligation? I receive a total of $794

No, the support is owed to the parent, not the child.

Q: My daughter turns 18 6 months before she graduates from high school. Doesnt child support have to continue?

He says he is going to send the checks directly to her and not to me anymore because she will be 18. But she will still be under my roof and under my care exclusively (she has been living with only me for 5 years).

He has to send the check to you UNTIL SHE GRADUATES OR TURNS 18 WHICHEVER COMES LAST, but not later than 19 and not if he can prove she doesn't live with you.

Contact the district attorney for your parish to file for contempt. If he hasn't paid in 6 years, you have 4 more years to do this. After that you start to lose money.

Q: Louisiana child support

Ncp claims to have child by his family members wife that he pays non court ordered support for.

He is also married to another woman with no minor kids between them.

Will this child be considered in our support case if he is able to provide a DNA test and bank transfers?

Preexisting support obligation will reduce his gross income for child suppoet purposes. Wife will not.

If the child support is just to pay the state back for your medicaid premium for 18 years, then no, you can't stop it or get it.

You need to get an executory judgment for the full amount of arrears. Then file that against him with the Clerk of Court as a personal lien. Then renew it every 10 years. Your attorney can also do a judgment debtor rule.
