If there is a bench warrant, you should retain an attorney to represent you. An attorney can file a motion to recall the warrant. If the motion is granted, the warrant will be quashed and the case set for trial. The attorney can then defend you on the charges. You should reach out to the attorney... View More
I’m a criminal justice graduate student and I do not want a speeding ticket to ruin my career.
answered on Mar 22, 2022
“Ticket” and “citation” are the same thing: interchangeable terms. They are the charging document for the traffic violation. Speeding is a minor non-jailable moving violation. It does not come up on a criminal background check. Your future career is safe. If you want to keep it off your... View More

If you were stopped by a police officer, then there are points and a high fine. You should request a trial and not a waiver hearing within 30 days. If the police officer fails to appear, you will be acquitted. If the police officer appears and you are convicted, the judge can offer probation... View More
I was told that i waiting to look and can no longer receive a court date. But it say no where on the ticket the due date of requesting a court date.
Can i still get a court date to fight this ?
Is it true that a date should be on the ticket of how long i have to request a court date ?
answered on Mar 4, 2022
The Maryland Uniform Citation form has an inset box on the lower right portion of the ticket that contains instructions on how to pay, plead to the ticket, and how to request a tial date, and it states the timeframe (30 days) you have to do it in. It is in small print, so perhapse yu overlooked... View More
I was told a law was passed that if incarcerated you don't have to retake everything

I am not aware of this law, but it does not mean that it does not exist. Your best bet is to contact the Motor Vehicle Administration and ask.
I received a citation for going in the opposite direction of a school bus stopped on the opposite end of the 5-lane highway (the highway is not divided, but has a center lane for turning vehicles).
answered on Feb 11, 2022
Yes, the statute applies under these facts. It would not apply if there was a median dividing the highway.
I am 65 and need for doctors etc. Also want to know if the points are still active if I get them back. Thanks

It depends on the reason for your losing your license in the first place. If it was for point accumulation only, then you were eligible to become reinstated following the suspension or revocation period. There are different procedures depeding on whether you were merely suspended, or were... View More
I have unpaid traffic tickets and can't afford to pay them, because of my injury what can I do?

We’re these fines imposed by a judge after you requested a trial date and appeared for trial? If so, and if 90 days or less has passed since the trial date, you can file a motion with the court for reconsideration and reduction of the fines
I never received any documents via mail for my citation or suspension notice. Is it worth appealing this or should I just pay the fine to reinstate ? **more details per my last questions response. It is a minor moving violation, and although I do not know NC penalties for this offense, in Maryland that would be a 1 point infraction, so a very minor non-significant impact on your driving record and no effect on your driving privileges. Again, you need a NC lawyer to explain the consequences... View More

answered on Jan 11, 2022
You do not state what the citation was for—how serious it is, or what the potential consequences will be if you simply pay it. Some states penalize speeding a certain mph above the posted limit as reckless driving, which can carry jail, or enough points upon conviction to result in suspension or... View More
Unlicensed driver rear ended another car on high way
answered on Dec 29, 2021
DO NOT PAY IT. It carries 5 points. That's 3 points short of suspension of your privilege to drive in Maryland, but will trigger a point system conference with the Maryland MVA. Conviction will also be reported to Virginia (if that is where you are licensed--you list Ashburn, VA on your... View More

Driving with expired tags: $500. Displaying and driving with tampered/altered tags, or with fraudulent intent: two months and/or $500. The length of time you drive with them does not change the possible penalty.
Do I have a chance to beat this ticket
answered on Dec 15, 2021
If it was a camera ticket, it only carries a fine and does not carry points. They will give you a link to a video of the incident. If you already passed the bus when the red lights flashed and the stop sign extended, then you should win at trial. Of course, it is up to the judge to decide the case.... View More
Indicates no turning / crossing the line from my side do I have to stop on a school bus sign/signal due to it just being for the opposite side of traffic in this case would those lines not act as a median of sorts for traffic ?
answered on Nov 29, 2021
Yes, you must stop for a school bus. The law says you do not have to stop if there is a median. A double yellow line is not the same. Take a look at the statute.
I received a citation for possession of a substance and I am now appealing the Judge’s decision. How do I prep for court?
answered on Nov 17, 2021
You hire a lawyer. A lawyer is trained in the law, and a criminal defense attorney is specifically trained in preparing, arguing and defending criminal cases. You are not. An open-ended question like yours is the equivalent of asking how do you perform a surgical procedure on yourself. Lawyers... View More
The bus driver was waiting for me to pass by before extending the stop signs and it just so happened to extend it right as I'm passing by. Can I fight the fine?
answered on Nov 8, 2021
You can always go to court to fight these tickets by requesting a trial within the time period listed on the citation. There are two types of tickets for passing a school bus. First, you can pulled over by a police officer. If this is the case, request a trial within 30 days and go to court. These... View More

Yes, the violation carries 3 points and a maximum of $570 in fines. You should request a trial (not a waiver hearing). A judge can both reduce the fine as well as grant a “probation before judgment” (PBJ) disposition that removes the conviction and points from your driving record. That will... View More

The police enforce violations of the vehicle code by way of issuing citations, warnings, and repair notices. Thereafter, depending on the nature of the citation, the court gets involved if you request a trial or hearing, or the MVA takes action based on imposing points, or suspension of vehicle... View More

If the bus was a school bus, you would be at fault if the stop sign on the bus was displayed. If it was another type of bus, it depends on what the violation alleges.
