It depends on several factors; however, the most important factor is whether he was already court-ordered to pay child support. If so, then the child support follows the child wherever she may live.

Q: So I havent knowm my daughter for 4 yrs. I found out shd was mine when she was 2. Can i terminate rights?

By the time i found out i had recently gotten married and had another daughter and moved into my own home with a new job.

I now have 2 kids and a son on the way and havent seen my other child in 2 years.

It depends. Was there an initial order in place establishing child support for the minor children? If so, then each time that a child support became due, it vested, such that he will likely be unable to discharge it.

Not unless your income changes involuntary or, upon review and petition of either party, a review of your income shows that it should be changed to make it consistent with the statutory guidelines.

You will need to talk with an attorney to discuss the facts of your case. Depending on the circumstances, like if she was trying to get government benefits for the child, then DHS may attempt to collect child support from you on behalf of the child and the mother.

Q: DHS was called on my relative. He was ordered to stay away from his children for 30 days. What are his parental rights?

There have not been any court orders regarding any aspects of this situation. He doesn't know what his legal rights are as a parent since DHS is involved.

It sounds like this may be something that went through youth court, which means that there may be allegations of abuse and/or neglect. Usually, there is an order established that limits any contact with the children while DHS conducts its investigation.

Assuming that you are still going through the divorce, the best thing for you to do would be to consult your attorney if you have one. From how it sounds, your wife is setting up a companion child support through DHS to ensure enforcement of any child support provision of the divorce decree.

Likely not. Once a child turns 21, they (not the parent) have 7 years to pursue back child support.

It sounds like she may be in contempt of court. There should a court order outlining visitation, in addition to child support. If there is indeed a visitation schedule, then she is required to follow that visitation schedule at a minimum.

It depends on what the language of your divorce decree and property settlement agreement says. Typically, there is special language in there that specifically highlights claiming the dependents for tax purposes, especially when there is a determination of custody.

Generally, once a child turns 21, they have until they turn 28 in order to seek any arrearage (back child support). Once you turn 28, you're cut off from seeking back child support from the paying parent.
