Q: I got a ticket in the mail that I did not stop on a traffic light but never got pulled over. I have a court hearing.

I was driving my sister’s car and I’m not the registergoing owner or on the insurance. Will that be a problem when I go for the hearing?

Q: I got pulled over this morning for tailgating and undercover police officer. He got out spoke to me and didn't ask

For any paper work. I was already getting some out. He walked back to his car and sat in there and drove off after a minute. Never said if he was giving me a ticket. Should I expect one in the mail?

Maybe? Unfortunately Attorneys are not bookies so your guess is as good as ours, but if you get the ticket in the mail its 5 points so I suggest you get yourself a good traffic ticket lawyer.

That would be true not just with this notice but any notice telling you to appear in municipal or criminal court.

More information is needed, but your GPS cannot give you permission to enter private property to turn around. You can only enter private property if your looking to business with the owner or store etc. Thus you have not presented a valid defense. A lawyer can eliminate the points on this ticket... Q: I parked my car same place where people park their car everyday. There's no sign saying no parking. My car was parked

for about 4 days without moving and it got towed for abandonment, but I live there and I got 5 tickets through mail and a court date. 4 of the tickets are 2 of the same and the other 2 the same as well on the same date and time by the same officer. Can they do that?

Many towns have an ordinance that you cannot park a car for more than 24 or 48 hours without moving it, this is probably the case with you. The best advise is to find a friend and see if they can loan you the money or to go to court when it is in session and beg the court for mercy which unfortunately is generally not given when you miss a court date.

IN NJ mistake on the tickets are mostly clerical errors such as you got and would not dismiss the ticket. As for can you fight the ticket sure, but the law states no trucks overnight, its no trucks over night thus you can't park it in the town and will have to park it in a paid lot as most... View More

Hi,

Yes they will issue a warrant if fine is not paid. However, if you are a NY driver, and received a ticket in NJ, you can just pay the fine, since the points do not transfer to NY.

You generally get delaying traffic but it's up to the cop.

When you travel to another state you are implied to know the law of that state and thus if you don't follow the law you are subject to getting a summons. Can you fight the summons, sure, can you win is the real answer and based on your defense I predict no.

Q: I unknowingly parked and received a ticket for parking in a handicapped spot in Newark NJ.

The spot was along the curb, the sign was located at the foot of the spot and was twisted toward the spot behind me so was not readily visible. It was also higher than the max 72" height. Can I successfully fight that this is not a legal handicapped parking spot?

Yes you can fight it, but in Newark it is hard to win any ticket even when the sign is not present. Having a lawyer increases the odds of winning, BUT is not economically effective unless this is 2nd or higher offense.

You will need to go down to the court and you can request a copy, generally 5 cents a page for each copy.

The utility access area is generally private property, BUT the police are given in most municipalities the right to enforce the local traffic laws on that property.
