Q: Can a cop issue a ticket without asking for my license or insurance card?

I admit I was speeding through the train station parking lot. I parked the car and my friend jumped out and ran to the train which was almost leaving. A cop pulled up behind me and then drove up to where I was standing outside of my car. He asked me why I was speeding and I told him the truth... View More

Yes, the cop does not need to stop you, just read your license plate with his scanner and identify that it is you the owner and can mail you the ticket without any stop of the vehicle. More and more tickets are issued this way, its safer for the cops and one of the reasons we went to digital... View More

Q: I got a speeding ticket and the officer said her printer wasn't working so all i got was a slip of notebook paper

The paper only had a ticket number and phone number to call to pay the ticket written on it. Is it still valid?

Well I think you will have a good argument in regards to the validity of the notice. That being said, don't be surprised if they don't send you a new ticket by mail. Meanwhile call the court to find out your court date, plead not guilty and I suggest you get a good lawyer.

Q: Based on NJSA 39:4-1, is careless driving (NJSA 39:4-97) applicable on private property?

That would require a written request per NJSA 39:5a-1. Also, this is a private school that has its own traffic fines/court. State v. Panther Valley says that a private entity forfeits the right to enforce traffic rules when it files such a request.

So, my original question is if there is a... View More

Yes, in most cases it is applicable because most private property owners have given consent to the police to police their lots.

Q: I was rear ended by a tractor trailer but received a ticket for illegal lane change.

I was still in my lane and not gone out of it. I went to court and the judge dropped my case. Will I still be able to receive payments from the truck driver to fix my car and my medical bills?

You may be able to pursue your accident / injury claim. Consult with a local personal injury attorney. In most states, the disposition - one way or the other - of the traffic citation does not control the insurance claim. Good luck.

Q: My $85 ticket was paid late, but within 1 month. Payment was rejected and a $240 fine given. Is that timing legitimate?

Shouldn't there be at least a month to pay a fine without penalties? I didn't plan to contest the ticket. I just put it on my monthly finances pile to be paid at my next personal finances session.

The ticket was for 'not stopping for pedestrians in the crosswalk'. The... View More

I believe it is a 3 point ticket so paying it may not be wise anyway. The ticket has a court date on it. If you are just going to pay you need to do it before that date. Otherwise you need to go to court. Missing court is contempt. I may be wrong but the $250 is for the contempt. Call the court to... View More

You have a very tough case unfortunately unless someone feels sorry for you, generally the rules are the rules in allowing you to take person items from the car. In any event if you own the car the law states you are responsible for the tickets.

Depends on the town and rules setup for the intersection and your charge. I suggest a lawyer as these tickets are taken seriously by the court thus generally have a mandatory court appearance due to the fact that some judges do give community service, and if a really bad record even jail is... Q: I recently recieved via mail a ticket for ficticios plate. What’s the worst that can happen?

My car was unregistered, and had no insurance because I was going to sell it, and it’s been parked ever since the registration expired. I’ve given back the plates and put on plates I had lying around my storage. Now they’ve towed it. Now, I’m concerned with these tickets .

The simple reason is because when you go before the judge, the judge sets the fine, they can raise it lower it or eliminate it. When you pay the ticket your given a straight fine.

Q: I got a move over law ticket in Edison. This is my 2nd ticket in over a year. Will I be able to remove these points?

You will not lose your license. Always suggest getting counsel as you have a better chance of getting a reduction in points and fines with one.
