On 2/7/19 we visited the Valley of Fire. When exiting the park I was pulled over and issued a ticket from a Tribal Officer from the Moapa Band of Paiutes. The officer said he clocked me in 3 different speed zones, all while he was parked near the exit just before I-15. I was given a ticket for $365... View More

If you want to fight this ticket, try re-posting this question in the state of Nevada. Most NY lawyers will not be able to advise you of Nevada law.
If you have a regular NY license, the points won't be added to your NY license if you are convicted of this ticket. If you ignore this... View More
traveling 2pm afternoon sunny day no traffic infractions. I believe NJ cannot enforce NY registration statutes as I have been ticketed for expired safety inspection but showed the statute reflecting their enforcing of only NJ registered vehicles.
He was picked up for 3 warrants. Aggravated unlicensed operator, obstructed view, and possession of a controlled substance 7th and has no bail. His public defender will not call me back and he has had no luck trying to call him. His mother is in the hospital very sick and almost died and he is my... View More

They need to release him within a week without bail if they don't do a probable cause hearing. The story sounds a bit extreme for a couple of non violent misdemeanors. Which Court are these charges filed in?
I am attempting to help an inmate have all tickets/fines dismissed while he is incarcerated. He is incarcerated at Coxsackie Correctional Facility in New York State. Is there a specific form they can request to have their counselor help file? Is this even possible? I seen something for California... View More

Are you an attorney licensed to practice law in the state of new york?
Pulled over for speeding via L-Laser, officer incorrectly named the vehicle year as 2007 (it is a 2017, not easy to make that typo since the 1 and 0 keys are not near each other. He also said that I drive a gray car, when I very clearly drive a tan/brown car. Is this ground for dismissal?
answered on Feb 4, 2019
Unfortunately not. Moving violations are issued to the driver, not the vehicle. If they have your name and DOB or address, or client ID number accurately that is sufficient.

You posted this question in NY, but then you write TN. Please make sure you are posting your question in the correct state.
I was overseas from 2007 to 2018. Never knew about that speeding ticket. My license expired since 2012. When I went to renew my driving license thats when I found out about the incident. In the system its say COURT APPEARANCE . Will I be arrested ?
answered on Jan 28, 2019
In New York the Courts don't arrest for traffic tickets which are aren't misdemeanors. They only suspend the driver's license. If you had a ticket for driving suspended, you could be be arrested for a short time.

He had a criminal impersonation charge, however the charges were dropped because it was just found on him an... View More

The tickets are in your name, so you need to appear in court (probably better off with a lawyer) to argue that it wasn't you. You should be able to provide an alibi for the date and time in question?
I had no idea that I'd done anything wrong. I was not speeding and am 61 years old. Cop seemed apologetic but still gave ticket.

If the sign was visible, you are obligated to see it. If the sign was not visible, you aren't obligated to stop. Either way you should fight the ticket, so you can get the 3 points dropped.
It is listed as a 4031 violation on my ticket.

You probably shouldn't have gone back to the station. If you were served with papers when you went back to the police station, then you know what you were charged with and when to go to court.
As for throwing the pipe into the woods, that was probably an error on the police... View More

You are responsible for and expected to travel at the speed that is posted and that applies to the roadway you are on.

If you are referring to a red light camera ticket, (that one receives by mail) then you are liable for the ticket as the registered owner of the vehicle. If the ticket remains unpaid you could face license or registration suspension.

Are you asking if it is a violation to hit another car intentionally? See New York Penal Law 145 "Criminal Mischief."
I received a traffic ticket in New York City. The ticket states the violation as “Motor carrier allow/require driver to use cellphone in cmv.” My car is not a commercial vehicle and I am not a commercial driver. My question is will the judge at the DMV throw it out right away, or will he be... View More

You are lucky, because it records as a 0 point violation on your driving record. If you fight it, they can change it to the correct 5 point charge in court.

You likely will not be extradited, however there will be a warrant issued, and if you’re stopped by police in any other state you could be arrested and held. If you don’t resolve the DWI, it is going to follow you around and create more problems than it’s worth. I recommend handling it sooner... View More
I was driving in the left lane, the bus in the right. Traffic was moving slowly and I was not speeding. I was passing the bus when it’s red stop sign came out, it was not engaged before. And I did not see any yellow lights, a cop that was sitting in the turn lane behind me issued me a ticket. I... View More

The police officer probably has a different version to the story: that the school bus extended it's lights before you reached the school bus. This sets up a "he said she said" situation. If plea deals are allowed in your court, try to plead down the 5 points.
