Q: Today I was on a 2 lane with a turn lane. There was a school bus who stopped as I was coming by. It had flashing

Yellow lights and I could not see if the stop sign was out it was dark I went past them and looked in my rear view and the lights were still yellow the car behind me stopped. Should I be worried about a ticket or points?

Depends on what you mean by "on a 2 lane with a turn lane'. If you mean there were two lanes in your direction of travel, a turn lane in the middle and two lanes in the other direction of travel with the school bus stopped in the opposite direction of travel - then you have no obligation... I was pulled over for speeding 64 in a 45. I explained my situation and the officer understood. He gave me a warning. However, my license was recently expired as I just turned 21 in late December and did not realize that they expired so soon after. He wrote me a ticket for “Operate a Motor... View More

Sure, do what he should have done 20 years ago. Hire a local traffic attorney to make sure the ticket is taken care of properly. Just 'paying it off' is almost always a giant mistake.

Q: Failure to transfer title within 28 days - guilty of class 2 misdemeanor?

If you don't transfer title within 28 days after sale of vehicle, NC G.S. 20-73 seems to indicate you are guilty of a class 2 misdemeanor. Does that mean if I go to the DMV and transfer the title now (including paying the DMV's late penalty fee) that I will have a class 2 misdemeanor on... View More

No, you do not just 'magically' get a class 2 misdemeanor tacked onto your record. You'd have to be formally charged and then convicted and most DA's aren't interested in prosecuting someone who didn't realize they need to do a title transfer. If you go take care of... View More

GREAT QUESTION

I am aware of no law in North Carolina that prevents an officer from issuing a ticket after-hours. It's frankly doesn't sound like a very safe/smart/nice thing to do.

Most NC defense lawyers would want to more about that fact-pattern before deciding how to...

Your question doesn't make sense. You do not get probation for pending matters. Do you mean a probation violation? If so, you really shouldn't get violated merely for being charged. Regardless, if you have a pending DWI - you need an attorney. So shop around for a DWI attorney in the... View More

TN can not make you pay the VA tickets but TN can keep you suspended from driving in their state (and other states if you have a TN license) until you do. This is regardless of whether you can be reinstated anywhere else. You should just man up, be responsible and pay what you own instead of... View More

Yes, you need to hire an attorney but you need to hire a Virginia Traffic Attorney. You do not need F. Lee Bailey for a traffic ticket so just go with the cheapest one you can find. As to how you can dismiss your ticket - you can't, you don't have that authority and the DA is likely not... View More
