Q: I received excessive x-ray exposure. Can I sue?

I fell due to a pre-existing medical condition in the middle of a road. I injured my nose and one arm. I went to an ER where the attending Dr. ordered multiple x-rays, at 12, I stopped the tech and said, "No more" and he stopped. He would have kept going if I hadn't stopped him.... View More

I'm sorry you injured your nose and your arm from a fall. As to the question of whether you can sue for excessive radiation exposure from x-rays, the answer - technically - is yes. It's easy to file a lawsuit, and most anyone can file a lawsuit for virtually anything. There is a... View More

Q: Does the hospital have a duty to discharge a person with adequate medications to handle pain?

My mom - 84 with dementia - was basically sent home to die with no added pain medication after a broken leg was fixed. No catheter - no nothing. Can they do that?

Reputable and well-run hospitals will generally take a number of measures to ensure good recovery following surgery. This can include their social services unit making arrangements for post-op care in an approved rehabilitative facility. It can include arrangements for a nurse to make follow-up... View More

I can't speak reliably for the actual Oregon Bar Association referral line (that communication is probably not a confidential communication subject to the attorney/client privilege), but the communication with an attorney is subject to the confidential communication privilege.

I'm sorry to hear of your experience, but this is not an immigration issue. I suggest speaking with a civil attorney and also contacting the police department to request that the report be modified to include all relevant information.

This would be what we call medical malpractice, and it happens because we are humans and prone to errors. Hopefully she did not have any bad reactions. If she did, then you would have a good medical malpractice case. If she was not harmed, there is still a small case, but not worth much (I settled... View More

Hard to say. If you had another way to get to the hospital you should have gone. On the other hand, if they led you to believe that you didn't need to go and you relied on that, there could be liability. But you will have to meet several prongs to have a case, first you have to prove not... View More

I believe a family member can request or demand an autopsy. (The family may need to pay for the autopsy.) This is something that should be done right away. It is probably too late if the body has been buried or cremated although there is a way to do some types of forensic autopsies on a body that... View More

Really hard to say, as it is my understanding that it is not uncommon to have small lumps that may not warrant a biopsy. I would search out a firm that does medical malpractice, specifically as to cancer-related cases as they would have the right experience for your issue.

Not my area of specialty but I believe there is legal grounds for a temporary hold (24 hours or 72 hours or something like that) if the police suspect that the person could harm themselves or others.
