Q: I have 3traffic warrents 4rm 09 with birthyear wrong.Have been stopped yrs later no mention of warrent.Reason 2 dismiss?

Not only have I been stopped since 2009. I was stopped just last year and issued more tickets. Why if I had warrents, was I not arrested for them? I have also been to jail for tickets in 2010 & 2012. Same county even same city.

If the charging instrument (the complaint ) has not been filed with the Court after 2 years from the date of offense, prosecution is barred by the statute of limitations. It would require investigation into your cases to see if this applies in your situation.

You can try going to the court early to resolve the tickets or hiring an attorney to resolve them fo you. If you hire an attorney make sure you stay in communication with them so that you can resolve the tickets and don't let them turn into warrants.

You may take a defensive driving class to resolve one of the moving violations. You must speak with an attorney in the county where your other citations are pending to discuss the effects one may have on another; each Judge has discretion on programs and requirements available to avoid... Contact a local attorney; you have committed a more serious offense by giving a false name to a police officer while you had outstanding warrants.

Race is not an element of a speeding offense. When the formal charging instrument is filed with the Court (the complaint), your race will not be listed. This clerical error on the citation will not cause automatic dismissal pf the citation.

An officer can issue a citation, which is just a notice of when and where to appear at Court, regarding events she/he did not witness. The officer, however, would not be able to testify to any facts he did not personally observe, and the question would be what evidence the State could produce to... View More
