I know my charge severity could be lowered by having my speedometer fixed, but I purchased a new car before the court date. I still have paperwork from having my speedometer calibrated, but it was never fixed before I purchased my new car.

The calibration can still be used as mitigating evidence of the speed to possibly get the case deferred for dismissal or reduced to a traffic infraction with minimal points and fine. Depends on the county where you are charged. Contact an experienced traffic lawyer to get a free consultation. You... View More

A Reckless driving conviction will give you 6 points, a class 1 misdemeanor criminal record and very likely an insurance increase for the next 3-5 years. This is not something you want to deal with by yourself. Contact a local experienced traffic attorney to what it will cost to represent you.... View More

You would need to contact an attorney in Virginia to determine if you are eligible for expungement. The petition for expungement would need to be filed where the offense took place, not where you reside. I would suggest reposting the question with Virginia as the location.

Your 1 year of good behavior (to obey all laws) started on the day of conviction. If you get a conviction for the recent traffic violation, that is failure of obeying a law. Such a conviction could trigger the suspended sentence to be converted to active time or to register a conviction on the... View More
The date on my summons to appear in court is January 25th 2017. The officer apparently messed up on the date. When I check online my case is not in the court system. The date to appear in court is before the ticket was issued. How can I appear in court before I committed the infraction? What should... View More

Sometimes the ticket is given to the clerk right before the court date. You should consult with a lawyer who can help you get the charge possibly dismissed or reduced to a traffic infraction. It is charged as a Class 1 misdemeanor and you may face jail time, high fines, and loss of license. Not... View More

There may be several options available to you such as amending the charge to a different charge. However, you should hire a lawyer in Virginia, as the speed you were charged at is a criminal offense in Virginia. Call a lawyer soon.
The 1st ticket in Tn was a failure to obey road sign. #2 was a reckless driving ticket in VA because my wheel axel snapped while turning sharp and lost control and crashed the car. This is when I was sentenced to driving school. #3 was a red light in VA that i got after I was sentenced to driving... View More

You can probably still take the class, but one of the requirements to having the court reduce/dismiss the charge is that you obtain no new tickets for a certain amount of time after you are sent to driving school. Call or meet with a traffic attorney, if you don't already have one, to review... View More

I think it depends on the size of the break, and what type of intersection - major crossing street, or simple turnoff into a neighborhood. If you've been charged under these circumstances, it would be worth consulting with a traffic attorney in your area to look a little closer at the law as... View More

Potentially jail. Don't do it. If you did do it already, talk to a lawyer.
Should I hire a lawyer? My court date is in February. The officer said that if I attend a defensive driving course that I could have the charge reduced or dismissed. How likely is it to be dismissed completely?

First things first; hire a lawyer to represent you in the traffic ticket proceedings in Virginia. Reckless driving is a crime, and has any number of consequences for you and your driving record. You can discuss what happens in NC depending on the results from the VA case.
So, on Christmas Eve, I was caught speeding. He said I was going 81 in a 45, but I THOUGHT I was going 70 TOPS in a 55. That doesn't make it right, but I genuinely had no idea I was going that fast or that the limit was so low.
He wrote me a ticket for reckless driving. It was on the... View More

Jail is very unlikely. However, if the reckless driving charge (a criminal misdemeanor) is not reduced to a traffic infraction, it could cost you major dollars in an insurance increase for the next 3 to 5 years. You should also check with the NC DMV to learn what they will may do if you are so... View More

Yes, a good traffic lawyer may be able to get the case deferred for dismissal with completion of a driver improvement course. Or possibly reduced to a non-moving violation like Defective Equipment that carries no points. This would save you six demerit points on your driving record and insurance... View More

Yes, hire a lawyer to go to court and get it dismissed or reduced to a traffic infraction. You have a great record, and it is unlikely you will lose your license or go to jail.
