Q: Hotel liability

Hello. I’m from Houston, TX and I just bought a car in Milwaukee, Wisconsin. While I was spending the night in a motel, my brand new car was damaged by the hotels shuttle bus driver.

You should the hotel for the name of its insurance company. You can then contact the insurer and make a claim.

Q: Can a company or business make you sign any paperwork with out fully reading it first.

They said they will tell us the main points and sign the paperwork right away and you can read the rest later after already signing the paperwork. They also said if anyone makes an ordeal over it they will take stuff away like the use of headphones and that.

The short answer is yes. The provider has breached its contract with your business and, as a result, your business is losing money. That is actionable in court.

Q: 2014 Dodge Dart was in a collision in Feb 2017. Car is still at the body shop (May) waiting for an Upper Core Support

Dodge has no ETA on when the part will be delivered. Isn't there some kind of law requiring a newer car to have parts available? Is Dodge at fault for not providing the parts I need to get my car repaired?

Q: A company is stating they are unable to remove a late payment from my credit reporting because it is illegal. True?

They state the FCRA requires them to do so. I have been in good standing and this is a one time occurance.

I am not aware of a law that makes such an action illegal - but most companies have a policy of not doing so.

These situations are very fact specific. I would recommend filing a complaint with the Attorney Generals office, as well as the Consumer Financial Protection Bureau. Otherwise, you will need to hire a lawyer ASAP to fight off the foreclosure.

Q: I bought a car from 199ride.com Wausau auto. They lied to the bank about my monthly income. Now the bank has backed out

Wausau auto is now demanding I return the car. The DMV says Wausau auto has to find me other financing but Wausau auto claims I lied about my income. None of my paperwork shows an income amount but they claim to have a document stating that I get $3000 a month.

What can I do?

They do have to find you financing; or service the loan at the terms offered. Locate a consumer lawyer for advice if they don't offer this to you - or worse yet, offer you worse terms from some other financing place. We call that "yo-yo" financing.

Q: My son (age 17) was committed to a mental health against our will, am I responsible for these bills?

We did not agree to have him committed and I told the officer my insurance does not cover mental health, but they took him anyway, now we have $4500 in bills for a two day stay. We did not sign any permission slips of any kind.

It's an emergency hospitalization and most insurance would cover that even if labeled mental health. If it doesn't it may violate the ACA. Make sure hospital submits. If son is diabled due to MH he may be eligible for Medical Assistance.
