They are not yours even if you have spent money on them. You can buy the dogs from your son if the parties agree upon the terms.

An eviction is legal if a summons was posted or personally served, a judgment was entered, and the sheriff executes a writ to return possession to the landlord.

There is no Missouri statute limiting late fees or requiring them to be reasonable. One was to defend against such fees is to argue that they constitute an unenforceable penalty, as opposed to liquidated damages.

The company either filed a case or it has not yet filed the case. I assume the company would sue under Missouri's computer tampering statutes, Mo. Rev. Stat. 537.525. She should hire an attorney before the situation goes terribly wrong.

If you feel that the charges are unfair, have you expressed those feelings to your attorney. A simple, polite request for him to waive the charges might resolve the issue.

I’m not aware of any rule of professional conduct that directly addresses your issue.

You can file whatever you want. Unless the lawyer agrees to dismiss the case and you have that in writing, show up or hire an attorney. The landlord may still be seeking court costs, late fees, and attorney’s fee. Bad things happen to defendants who allow default judgments.

Unless your contract has an arbitration agreement that precludes a lawsuit, then you may sue. If your company is the plaintiff you may represent it in small claims court, but if a trial de novo is sought you’ll end up having to hire counsel and spending a lot of money fighting over a small sum.

Q: If I’m being sued by a creditor and they have a lien on my bank account can I cash a check without it being touched?

If a garnishment has been served and is has not expired, it would not be safe to cash a check.

Q: I recently went through the process of selling my house. The agreement was for the buyer to assume my loan/debt.

I just found out they did not go through the process of assuming the loan with my lender. They just want to pay the payments and have no intention of transferring the loan out of my name. Do I have any legal recourse?

You can sue the buyer for breach of contract or specific performance.

They’ll need to locate you. A public records search might reveal your new address. For example, a driver’s license or vehicle registration.

Bad situation. If he is threatening you, get an order of protection to have him removed from the residence. Seek some social service assistance for abused women.

Your friend ought to hire an attorney to review the docket sheet and contact the plaintiff’s attorney. There’s no general right to a payment plan but without reviewing the docket and correspondences with the collection agency it is hard to give an informed response.
