Q: is it ethical for lawyer to communicate with court visitor and not share with opposing counsel this was done?

Judge ordered a court visitor for competency evaluation. The proposed ward hired a lawyer to halt the proceedings. The lawyer bringing the case then met for two hours with the court visitor before the evaluation while the counsel hired to halt these proceedings was not informed. The evaluation was... View More

Hello,

Court visitors are charged with providing an independent assessment. The fact that the Court Visitor met with the attorney is not alarming and even not that unusual. Remember that the attorney is an agent for the person petitioning for the guardianship/conservatorship and the...

Executor won't give copies of probate papers or any papers regarding the sale of her home. Now he refuses to answer our calls or texts and says will only contact us through mail. He has been talking to one beneficiary and not the other two.

Hello,

I am sorry for the situation. I am not sure why, but I often see the executor stone wall beneficiaries. It sounds like you signed a waiver of notice or else everytime he filed something the Court would require that he also send you a copy if you are in fact a beneficiary. The...

I am glad that you are concerned about your father. It sounds like they are dealing with some of the common issues that come with aging.

When I hear this, it doesn't make me too concerned. They may be trying to do some sort of Medicaid planning or VA planning. The first questions...

Contract law imposes a duty to mitigate damages. So if you breached the agreement then technically you are responsible to pay rent for the months that you said you would in the contract. However, if the property management company is able to "re-rent" the place quickly then this would... View More

Animals are considered property. She now has the animal, so I think that it would be hard to take it away from her. If you still had the dog you could have claimed the puppy "abandoned" and went through the process of changing ownership. Unfortunately, I don't think you can do much at this point.

I've seen the "2 out of 5 years" rule floating around, but I'm not sure I fully understand it. It sounds like you must have lived there for 5 years total, but at least 2 of them had to be your primary residence...The home in question was my primary residence for almost 3 years... View More

There are two independent tests that you have to meet: the "use test" and the "ownership" test. You have to meet both of them in order to claim the exemption.

He is using language that suggests that there isn't immediate distribution. This is not typical of a will. This is typical of a trust. The...
