Are you sure your license isn't currently suspended? The DMV usually suspends for failure to comply with court-ordered fines, or for failure to be reinstated from your DWI conviction (which would include the county you were convicted in confirming to DMV that you had paid all ordered fines).

You cannot expunge a DWI conviction from your NC criminal record. You used to be able to, but the expungement law was changed as of December 1, 2015. Hopefully, the legislature will revisit the law and revise it one day.

As of December 1, 2015, DWI convictions are no longer able to be expunged under NC law. Hopefully the legislature revisits this, and revises the law, but until that day, you will not be able to expunge your DWI at all.

My car was totaled and no longer drive-able, I was told if I could produce a document from my car insurance saying they paid damages for the other car, I might be able to get out of this, is that a possibility?

Yes, that's possible. Contact your insurance company and ask them for a letter stating that they are taking financial responsibility for the property damage. The State will likely dismiss the case against you once you produce that letter at your court date.

The best action you can take is to hire an experienced traffic attorney in the county where you were charged to handle this for you. If you've never had a ticket before, you should be able to get a great result that won't result in your car insurance rates going up.

You should be able to get a letter from your insurance company to state that they are taking financial responsibility, and should be able to get the case dismissed.

There is no other way in NC to remove charges from your criminal record other than expungement. $4000 is a lot for an expungement of this type. I would keep calling around for quotes.
The court house in the county this happened told my VA rep I can have it expunged. Sent me all the paperwork, does this sound fishy? other than this my driving record and criminal record are clean.

Sounds like you sought out a private warrant against someone else. Generally, once you do that, it's no longer up to you to "drop" the charges against that person: it is within the discretion of the District Attorney's Office if they will dismiss the case.
